Why you shouldn't dispute via annualcreditreport.com

The FCRA and FACTA allows consumers one free credit report every 12 months for each of the CRAs.

The standard investigation guildelines are 30+5 days. This means if the CRA does not respond within 30+5 days the account is dispute MOST be deleted. The extra 5 days are for mailing. If you dispute items via annualcreditreport.com the following stipulations apply:

--

 612. Charges for certain disclosures [15 U.S.C. 1681j]

(3) Reinvestigations. Notwithstanding the time periods specified in section 611(a)(1),
a reinvestigation under that section by a consumer reporting agency upon a
request of a consumer that is made after receiving a consumer report under this
subsection shall be completed not later than 45 days after the date on which the request is received.

--

What this means is you are giving the CRAs an extra two weeks to investigate (45+5). This can cost you deletes and makes you wait longer for results. You should always file your disputes from a paid report. For your conveinece, there is a dispute link included on your MyFICO report that will link you directly to the CRA dispute form.

Re: Why you shouldn't dispute via annualcreditreport.com

I had already made the boo boo of disputing via annual credit report on experian website. Does it hurt to resend a paper dispute. Or go ahead and pay for reports and redispute.

Re: Why you shouldn't dispute via annualcreditreport.com

Thank you Tuscani!!!! I have read this before but I only saw the 45 day on the reinvestgations.
I already made the mistake of filing mine using the free. I am doing hubby's now & wanted to be sure.
I know that you can not keep track of every states SOL laws but if anyone is looking I have the legal SOL for the state of CT.
With all the help from you and others I just might get through this.
Thank you all very much.  I love this forum!!!!!

Re: Why you shouldn't dispute via annualcreditreport.com

What is the reason why the CRAs use the 45 day rule for a free annual credit report.
I don't understand this.  When the law was put in place that all consumers would be entitled to a free credit report the 45 day rule was not publicized.  I am sure that if consumers knew that this would stop a deletion they would have fought against it.  It does not give the consumer the opportunity to review their completed investigation to determine if they need to request a re-investigation.
Knowing the CRAs they are not doing a re-investigation on any dispute, merely waiting the 45 days before notifying the consumer about the results of their disputes.

Question:  I have a 3 in 1 credit monitoring account with TrueCredit, and I went to TransUnion to file an online dispute, put in my user name and password, when I clicked it took me directly to annualcreditreport.com.  I did not understand why.........since I had purchased my credit report a couple of months before.  I am still waiting on the results of my disputes from TU.  I have received EQ and EX, because the option for annualcreditreport.com did not come up at their sites.

Does anyone know why this happened.

Re: Why you shouldn't dispute via annualcreditreport.com

Bren, I filed free and received final report within 30 days. Maybe I didn't have complex issues, but I will not do it again.

Under any conditions the CRA has 45 days IF they are waiting for report from a creditor!

Re: Why you shouldn't dispute via annualcreditreport.com

I also disputed information through annualcreditreport.com. I disputed on November 27, 2007. My question is, is the 30-45 days business days, or are the weekend and holidays counted? it's Feb 7, 2008, and I still haven't recceived anything in response to the dispute.

Thanks,

Christie
