401k and Bankrutpcy

Hello all, this is new as I am also new to the forumn. My question has to do with my 401k. I just had my meeting of credotors (341) yesterday and have been thinking about what I want to do with my life. Been sick alot (2 surgerys past two years) led me to my filing as I also have student loans and noramls bills like housing and credit cards. Well I have been thinking about if I am going to be staying with my employer (been thinking about it for over a year). Well my 341 meeting was the last straw. My brother had to take me cause my truck decided it needed repair. I have enough in my 401k to purchase a decent (new) vehicle after taxes and penalties. I have been thinking about leaving my employer for something that makes me happy and I am now in need of reliable transportation.

My question is: Is it safe for me to quit and take a payout and purchase transportation or do I have to wait for the discharge notice? The trustee mentioned something for 180 days for inheritance and lottery winnings.

Can anyone help me with this account? Im willing to try 100% to clean my life up and not give up on myself anymore. I didn't realize how much negative credit affect a person even when you are trying to get a better job.

I am trying to repair my report as much as possible I have recent took a long look at my credit reports and start to notice different things. I had just given up on my credit after I filed BK in 2006. I have been told on several occasion that I need to start opening some new accounts to help me as the old stuff start to age off. I notice that Clear card/ Merrick bank on my Experian report Account history is reporting different information. On a report from 3/10/10 the account history states that the Account was included in BK on Feb. 26, 2009 and on the report for 5/21/13 the account history states that the Account was included in BK on April 4, 2007. Experian is give me the date of Nov 2013 is when the account is scheduled to be removed.

I filed for the BK on 12/18/06 and was discharged on 4/04/07. Experian keeps given me the UPDATED each time I have filed a disputed.

Rebuilding *during* Chapter 13?

I posted on the rebuilding forum but didn't get a response so I am going to ask this here. We are currently 1 year into a 5 year Ch. 13 BK. We were just approved for a $1000 secured CC through a local bank (who uses Elan Financial). Other than that, we are paying our mortgage outside the BK and two car loans through the BK.

I pulled my credit reports yesterday through annualcreditreport.com. (Actually, was only able to get TU and EXP online - I have to mail in a request for EQ.) There are MANY errors on there. We filed 04/30/2012 but some accounts show BK in June or July and us late until then. Other accounts report Ch. 7 BK instead of Ch. 13. And, finally, the biggest error (to me) is that one of the car loans does not show IIB and has been reporting us 120 days late for the last several months. I am actually amazed that we were able to get the secured card. (Also tried Cap 1 and was declined for the secured card. :smileysad: ) Should I try correcting these errors? Or do I need to wait 4 years until the BK is discharged? If I should correct them now, what paperwork do I need from the BK attorney? I would appreciate your advice.

Auto loans post chapter 13 bankruptcy?

Hello everyone, my chapter 13 bankruptcy will be over at the of june 2013, me and my wife plan on buying new vehicles closer to the end of the year. My credit score is 630 through equifax. My wife has an 07 sebring that's paid for, and will be used for trade in at the time of buying. And I will have about 4000 cash when I go to purchase. Our family has grown since we filed for bankruptcy, and the need has arose to upsize our vehicles. Can anyone tell me from experience what I should expect for interest rates, and lender requirements. Or, will such companies like ford financing lend to people like me and my wife? I have been able to obtain unsecured credit cards during my bankruptcy. All with low limits, and no late payments.

Very confused about TransUnion score

Filed BK7 in August 2012, discharged November 2012. Have been cleaning and everything is correct except some Capital One errors on Experian. Have been approved for Kohls and Target. Applied for the Walmart card and was denied. Denial letter shows a TransUnion score of 477. This didn't make sense as everything had been kept current right up until the bankruptcy and the bankruptcy, as bad as it is, is the only derogatory on TransUnion. All old accounts show IIB with a $0 balance. I signed up for the free 7 day trial on TransUnion and the score they gave me was 707! How can this be? Both scores came from TransUnion and they are off 230 points!

Hi, I looked on Pacer and saw that it said my bk was discharged and it was updated on my equifax(sw alert). So my question is, when should I pull all my reports and dispute anything not showing iib and $0 bal? I want to get a secured cc to start rebuilding, but I also don't want to get declined and waste an inquiry...what is my best course of action?

I have a ch. 13 filed in march 2006 that we closed/dismissed 4/07 without having it discharged. From what I've read they can stay 7-10 years since it didn't get discharged. Is there anything we can do to have it removed after 7 (since we've just passed this mark) as opposed to 10 years? If not, how much is it effecting my scores right now, 7 years later?

Thanks!

hi everyone!

I thought my dealings with bk were over but for some reason I decided to call the # for my old shell, exxon, sunoco, and citgo cards today. accoring to the automated system the accounts still have balances. before bk, they were sold to various collection agencies and after the bk posted the old tradelines for both the original accounts and the co's were deleted from all bureaus. my question is should i have the original accounts reflect $0 balances since they were included in bk via the collection agencies? I'm thinking I may never be able to get these accounts ever in the future b/c it looks like i already have accounts with balances. the bk was discharged 3-12. thanks!

Online Bank Acct's that are good for people post BK?

I wanted to get some feedback from the community on this. A good friend of mine just filed BK a few days ago and has been using Paypal Prepaid as a bank acct where her direct deposit goes into. I guess the paypal pre paid site is down indefenitely and I'm trying to convince her to just move everything over to an online only bank with no fees for direct deposit. My logic is she should go with Capital One 360 since that will allow her to have online access, a debit card, a savings so she can start building one up, and building history with Cap One since that will probably be her best bet for a secured card down the road when she can start to rebuild herself. I work in banking so I'm pretty wise to how things work but wanted to get some feedback to see what ideas/opinions you might have, maybe there's a bank that might work better for her? She lives in Eastern TN btw in case that helps w/ bank ideas. Anyways, thanks for reading this and I look forward to reading some constructive feedback!

Apparently, I made my last Chapter 13 payment back on the 29th of March, the trustee mailed me a refund of monies that were left over I suppose after the audit was complete. My question is this, on the National bankruptcy database, it states that the case is closed not discharged and also it is not showing up on any of my credit reports as discharged. I went through a nasty divorce and at one point my 13 was dismissed for non payment because my spouse was taking the money I was sending her and doing whatever she wanted to do with it (I am currently in Afghanistan) long story short, me and my attorney had to work extremely hard to get it reinstated and once it was I made the payments myself until completed, when can I expect it to show on my credit report as discharged and should I be concerned that the national data center is only reporting it as "closed-J"?

Hello,

Looking for some advice.

Filed BK7 in Nov 2012, Discharged in Fed 2013, asset case, so still open, hoping the clousure process will start next month.

Is it better to wait until fully closed to apply for a new cc? Credit Scores range from 686 to 715 currently. Never stopped making my car and house payments, all current and on time, also have a store card currently with a low balance which was not IIB, made all payments and has been alway current.

Thanks

PG

Quick BK7 question regarding Credit Score

I filed in Nov 2012, discharged in Feb 2013, case still open due to assets. My current scores, 686 - 716. I have paid my car, house and one store card throughout the BK, I have NEVER been late, ever. When the BK is finally closed, will my score up in either direction since it is finally closed?

Thanks

PG

Debt charged off to bankruptcy years after bankruptcy occurred?

Back in 2005, I had a bankruptcy. Before the bankruptcy, I had been a customer of Verizon Wireless. In 2008, I switched cell providers but inadvertently forgot to pay the last bill with Verizon. Now, in 2013, they are reporting it as being included in the bankruptcy. I called them, and they said that it had been sold off to EOS/CCA, but that isn't reporting on any of my credit reports (and I don't want to wake that sleeping giant!).

I went through the dispute on each bureau, but the dispute came back that it was a valid note. On the phone, the representative told me that there is nothing I can do, but I know that isn't true. They are claiming because it was included in the bankruptcy (which, since it was a debt incurred after the bankrupcty would be impossible), they cannot even take payment for it, and that I simply have to wait until it falls off in 2-5 years.

I'm not against paying it, but I'm not certain what route I should take to resolve this. The representative told me I should contact my lawyer (I just might do that anyway), but I thought I'd post here and see if there was something I could do in the meantime (or maybe just have more information to take to my lawyer).
