The FCRA and FACTA allows consumers one free credit report every 12 months for each of the CRAs.

More info: http://www.fdic.gov/consumers/consumer/alerts/facta.html

The standard investigation guildelines are 30+5 days. This means if the CRA does not respond within 30+5 days the account is dispute MOST be deleted. The extra 5 days are for mailing. If you dispute items via annualcreditreport.com the following stipulations apply:

--

612. Charges for certain disclosures [15 U.S.C. 1681j]

(3) Reinvestigations. Notwithstanding the time periods specified in section 611(a)(1),
a reinvestigation under that section by a consumer reporting agency upon a
request of a consumer that is made after receiving a consumer report under this
subsection shall be completed not later than 45 days after the date on which the request is received.

--

What this means is you are giving the CRAs an extra two weeks to investigate (45+5). This can cost you deletes and makes you wait longer for results. You should always file your disputes from a paid report. For your conveinece, there is a dispute link included on your MyFICO report that will link you directly to the CRA dispute form.

-Tusc

What is the reason why the CRAs use the 45 day rule for a free annual credit report.

I don't understand this. When the law was put in place that all consumers would be entitled to a free credit report the 45 day rule was not publicized. I am sure that if consumers knew that this would stop a deletion they would have fought against it. It does not give the consumer the opportunity to review their completed investigation to determine if they need to request a re-investigation.

Knowing the CRAs they are not doing a re-investigation on any dispute, merely waiting the 45 days before notifying the consumer about the results of their disputes.

Question: I have a 3 in 1 credit monitoring account with TrueCredit, and I went to TransUnion to file an online dispute, put in my user name and password, when I clicked it took me directly to annualcreditreport.com. I did not understand why.........since I had purchased my credit report a couple of months before. I am still waiting on the results of my disputes from TU. I have received EQ and EX, because the option for annualcreditreport.com did not come up at their sites.

Does anyone know why this happened.

Bren, I filed free and received final report within 30 days.

I also disputed information through annualcreditreport.com. I disputed on November 27, 2007. My question is, is the 30-45 days business days, or are the weekend and holidays counted? it's Feb 7, 2008, and I still haven't recceived anything in response to the dispute.

Thanks,

Christie

This is good to know. I did recently dispute two items, one not mine and the other past the 7 year mark, via ACR and TU deleted them in 36 hours. I suppose I lucked out. In the future, however, I'll still with snail mail.

About 3 weeks ago I filed dispute using annualcreditreport.com and not only did I not have any issues, the response time was very fast. The timeline was something like this:

Tuesday, 5pm checked report via annualcreditreport.com. Found discrepancy. Account claimed 5 lates, I knew of 2, 3 max.

Tuesday, 5:30pm, report submitted.

Friday, 1pm Response received. Baddys removed from my CR, account status now: Paid, Never late.

Just my own experience. Perhaps things have changed since this thread was made?

I wish mine would go quickly. Actually, I wish I had never made a dispute. I did so with TU and EQ. TransUnion took care of it within a week. EQ is still pending (7/16). I emailed to see if I could cancel and they told me to call this number. I did, and spoke with a rep and he said he couldn't delete it. I replied to that email and told them what the rep said. EQ emailed back saying that once it's under investigation, it cannot be deleted. I really hope it goes quickly. I'll be going for an auto loan in two to three weeks. If it's still open, I fear it will impede on a loan approval.

Hi DBinSJ,

This thread was started 5 years ago and the last post was almost 2 years ago. It's highly unlikely that you're going to get a response from those individuals.

Having said that, the argument against disputing through annualcreditreport.com is not that these disputes are not effective, but rather that it can result in a delay in the resolution of the dispute, since law allows for a longer reinvestigation period as compared to the standard. At least that's the way things were 5 years ago - I don't know if there have been any substantive changes to the industry standard or the law.
