ER Solution sof pull yesterday on my credit report

Hi Forum! I need some advice.

Today, I checked my experian credit report soft pulls and noticed a soft pull dated 5/5/2012 from ER solutions. Why in the world would they soft pull me??? I don't have any outstanding bills that I am not paying.

I'm very worried because I've worked very hard to get my credit back on track.

Should I contact them tomorrow to find out what reason they have to pull my credit history? I DO NOT want anything popping up on my credit report out of the blue!!

Any help/suggestions someone can give me is GREATLY appreciated!!!

I'd prepare a DV, but I would hold off until you receive a dunning letter. Between now and then, I would not worry.

A CA cannot add a collection to my credit report until they have contacted me? This is nuts. I have trying all day, but I can't think of anything that could be be sent to a CA. I'm praying it's not anything fraudulent.

A CA can add themselves anytime. They don't need to warn you first. They do have to send a dunning letter once they engage in collections, including reporting.

If this is the case, I'm wondering if I should contact them tomorrow to see why they would look at my report. They just can't arbitrarily look at my file without any specific purpose, right?

The last thing I want is for a collection to show up on my CR!

You are correct, unless they have a permissible purpose under a provision of FCRA 604, they cannot access your CR.

Debt collectors must have an assigned collection authority or ownership before the "collection on a debt of a consumer" permissible purpose applies.

You can call and ask. However, by pulling your CR, that is an inherent statement that they are collecting on a debt.

You can DV them immediately, without need to wait for dunning notice or any other contact from them. REceipt of your DV will bar them, until such time as they provide verification of the debt, from reporting to the CRA.

I will call tomorrow. I'm really concerned about this because I honestly have no idea what this is. I was reading some of the threads and it seems like the CA is used by a lot of utility/telecom companies. I've been in my house for 10 years and the only thing I ever switched was my phone service.....and I know I paid the final bill in full. I even get 'please come back' letters in the mail.

I'm more concerned than ever that someone my have used my identity to get some utility in their name. Scary!!

It's interesting that they check my file AFTER I start the process to refinance my mortgage. The soft pulls on my report go back to 2010, and this company shows up one day AFTER my mortgage company pulls my scores to qualify for refinance.

In a way, their soft pull could be an advantage.

It does not impact your scoring, and it alerts you that someone is out there lingering about with bad debt collection intention on their mind. You are taking action now that you would not otherwise be taking.

It could be argued, similar to reporting a collection, that a credit inquiry is a communication with the consumer that triggers their requirement to send dunning notice within 5 days. The primary intent of dunning notice is make the consumer aware in a timely manner of the initiation of collection activities.

While I am not aware of specfic precedent that an inquiry is a "communication with the consumer," it might bring into play the same logic that holds reporting of a collection to be a "communication with the consumer," triggering requirement for dunning notice.

This is off topice, but CRAZY! I googled ER Solutions this morning to get a phone number to call them. the first site that popped up was mortgagefit.com which apparently is a forum. The original post on that forum was posted last night and says this....

Strange, I'm subscribed to see where this leads to. Perhaps this company just runs risk analysis for the bank that you are applying for your refi through?

I called a number for them that I found online, and they had no record of an account for me. This was their Texas office. The lady told me that anything on my CR from them would not say ER Solutions...they stopped using the name at the end of last year. I told her that it says ER solutions with a Washington address. She gave me the number to their Washington office. I'm now waiting for them to open so I can call. If they do not have an account for me, someone in their office will have some explaining to do!!!

The post to another forum gave me the creeps...but, since everything is annonymous, i'm not going to continue to stress.

Update:

I finally get in contact with the Washington office (they must start work EARLY). The woman proceeded to tell me that this is for a phone bill back from 1998...yes, 1998!!! I told her that I needed the phone company to send me proof that I owe the bill because I don't believe that I do. She then told me that they collect on behalf of Resugeant (sp?) Capital. I told her I don't care who she works on behalf of, I need proof from the OC that I still owe this bill.

I moved from one state to another state back in Mid-1999. I did have this phone company back when I lived in the other state, but if I owed them from back in 1998, it seems they would have cut my service back then.

I am now wondering what my next steps should be. I'm guessing that since this is outside of the SOL and CRA reporting time, I'll just wait to see what they send me....and not worry about it.

What are your thoughts?

I wouldn't worry about it. Like you said, they are outside of the SOL and the CRA reporting period so they are really out of luck at this point, even if the debt was legitimate.

Not that I know of, as long as they are only posting a soft pull I really wouldn't worry about it. I bet that this account just came across someone’s desk and once they realize that it is both unenforceable and unreportable, they will probably CO internally and move on. The CA probably purchased it in a junk loans lot and this is just one of the ones that are not going to pan out for them. I don't see any reason that they would continue to pull your credit.
