Annoyed with attorney

Hi,
I've recently paid my attorney in full to retain, completed bk course (prior to filing) and submitted everything last week. I called paralegal to find out status/turnaround because we're getting certified letters and attorneys collection agencies are calling is and getting aggressive. In speaking with the paralegal I find out the petition may not be finalized until next week or the week after. I'm SO very annoyed. Here me and my husband do everything timely and now it seems like they're dragging their feet because someone was on vacation and then got sic. I'm so afraid of having my wages garnished or bank account locked. I work for a small company and would be so embarrassed if my HR manager informs me if a garnishment order. There's not much confidentiality there! I don't want anyone finding out, it's bad enough to have to go through his...

My attorney told me he would have this done this week due to a mix up in the amount of the retainer. I was told $1200 and it ended being $1350. I'm so stressed and would feel much better once the petition is entered and we have bk#

Has this happened to anyone? Any suggestions?? Am I overthinking??

Sorry, I might be confused, But if you have retained an attorney refer any and all calls to his office.  And refuse certified letter. This is why he was paid regardless of when the petition is filed.  And don't stress soon you will be able to answer the phone again.

Sounds like you waited a bit late to start the process, which is quite common. I am sure the attorney is getting things done as quickly as possible. Keep in mind once filed, recent actions taken by creditors can be reversed. The BK process is very stressful, but a few months from now the stress factor will have been worthwhile. Believe me, the fresh start is worth it all...if you allow it to become a hard learned lesson in life. I filed in 1996, and have had around 800 credit scores for 10 years straight now. Do not get too discouraged, you will go through 3 months or so of high stress for a new lease on living a normal life, there is light at the end of the tunnel.

Re: Annoyed with attorney

You ar correct. We probably did wait too long :/. We were going back and forth contemplating about filing. Thank you so much for the encouragement. I'm sure there's light at the end of the tunnel but this is so stressful waiting on others. Wow! That's a big accomplishment. It inspires me to press on!!!

Re: Annoyed with attorney

That's exactly what he told me to do, refer calls to his office. And I didn't answer the door to accept the certified letter. Guess I'll feel a bit better once I have a bankruptcy docket#. Trying not to over think things.

Thanks for your response! Appreciated!

Also, it takes court action to garnish wages, forclose, or get judgement, and once bk is filed it puts an automatic stay on all of that...it will stop it all cold. Just dodge your creditors until filed. Once you have a case number, answer all creditor calls, give them lawyers name and case number, and they are required to cease all collection activity. They can not even call you at all after that or they will be subject to possible lawsuit payable to you.

It is a matter of public record, but her friends and work will only find out if they do a public records check or something. Usually the way they would find out is if you told them. Public record does not mean they put it on a billboard.

I doubt her boss or coworkers will google her name...but I could be wrong. I have often googled my own name too, but never googled my friends or co-workers names. It would also probably come up on google for only short time after discharge. I found out some friends and family had file years after they did, but only because they told me. It is true anything in public record can be found by anybody...but most people have better things to do than google search all their friends.
