Can my wife declare BK on her own, or I am I included automatically ?

May sound strange, but I just got married and my wife ex-husband did not pay anything the court ordered him to so now they are coming after her for payment. Can she declare insolvency on her own. TIA for any help

It may vary from state to state but she can file on her own but any joint accounts will most likely be included in the BK. You can always reaffirm those debts if you choose to do so.

Thanks, I have no joint accounts at this point don't think I will until I can get this resolved.
