I am 1-1/2 years into my 5 year CH13 plan and am stuck with a horrendous adjustable mortgage. I filed to save my house but the monthly payment is killing me. I've been told that it is impossible to refinance while in BK. If true, this is bizarre and unfortunate as with the low interest rates available, I could lower my monthly payments to make the BK more workable. As it stands, I'm trapped in an extremely high rate and fear falling behind. Any ideas or am I out of luck? Thanks.
I was told recently that you can (with Trustee approval, as is required for any debt during the process) refinance with FHA 1 year after filing CH13.
Hi 4Papa,
No, you're not out of luck.
I don't know who your source was, but they're incorrect.
You can refi during your BK with trustee's approval.
One thing I would mention is to make sure your credit reports are accurate and in order.
When we looked at refinancing during BK, our reports were a mess - especially those accounts which were IIB and not reporting correctly.
This caused our FICO score to be horrendously low. And although our mortgage options were quite limited because of this, we did receive a financing offer.
We did not go through with it at that time because we did the math and long-term it wasn't a great deal.
In addition, our bank mortgage gal did not understand credit reports and things FICO and told us our reports were reporting correctly. It wasn't until after the BK was discharged that we learned how things should be reporting and cleaned them up. It wasn't that hard - it did take a few months.
Then we got a great deal on refinancing our mortgage.
One other caveat - be aware of who your lender is before signing papers. And make sure you go with a legitimate lending agency. Very important.
Current rates are sweet - as you already know! Best wishes!
Thanks. That's certainly good news.
What's the best way to know if your credit report is accurate? Is there a source for checking who should be reporting what and what's "IIB"? Thanks.
IIB -Included in BK
An account that is included in your bk, should be reporting included in bk and not show lates and should also report a $0 balance.
Pull all 3 of your reports and if any of them are not reporting correctly, dispute included in bk and CA usually fix right away
Lates prior to filing BK may remain but none can be reported after filing.
Do accounts included and discharged through a BK get removed from the credit file or do you have to wait 7 years?

Accounts included in bankruptcy will remain 7 years from the date they were reported as included in the bankruptcy.
Is that what you were asking?
From a BK years ago to:
EX - 9/09 pulled by lender 802, EQ - 10/10-813, TU - 10/10-774
