My discharge may be delayed

I am so sad.  I went to my attorney's office today to give him copies of this year's tax returns to file with the trustee and I asked him if I was still on track to receive my discharge in a few days and he said he wasn't sure and that since they were taking my tax refunds for this year that I might not get a discharge until the court had received them.  I then called the bankruptcy court clerk and asked her, she looked up my case and said "oh, you better sit tight."  I have no idea what the heck that means other than I'll be delayed.  I have zero control over when the state and feds will issue my returns and yet I may be held hostage until they do.  Does anyone else have any experience with this?

Re: My discharge may be delayed

Unfortunately you will have to wait until the courts receive your tax returns for your bankruptcy discharges. I filed chapter 7 back in 2004 and I did mine in in Feb and I was Discharged in April of '04

Re: My discharge may be delayed

I have another question. It looks like no creditors have filed a proof of claim, unless those aren't listed on pacer, if that's true then what happens to my taxes? Do they come back to me, or does the trustee keep them to pay himself?

Re: My discharge may be delayed

It's a 7, and the last day for creditors to file anything is tomorrow, 2/4. Am I right that any proofs of claim would be on pacer?

Re: My discharge may be delayed

So I got yet another answer today.  An associate at the firm tells me 60-90 days after the 341, which is what I expected in the first place.  Who knows what's going on.

Re: My discharge may be delayed

60 to 90 days after your 341 is a completely normal time for discharge on a CH 7 so it sounds like things are going well for you! Don't stress, you have done the hard part.
