Obtaining Mortgage Ch. 7

I have seen discussion about obtaining a mortgage after a Ch. 13, but what about Ch. 7? Does anyone know the specifics? I filed in January 2012 and was discharged in April 2012 and we reaffirmed our mortgage so it was not IIB. Do we have a waiting period before we can obtain and new mortgage?

My BK Attrorney told me it was 2 years after Chap. 7 Discharge. I would like to hear others comments on this.

The real answer to this is no. You don't have a blanket mandatory waiting period that applies to all mortgages after a BK. FHA mortgages require you to wait 2 years after a 7 discharge, and some conventionals make you wait 3-5 years. But, if you have a large enough down payment and find the right lender, you can get a mortgage immediately after a BK7.

There is a problem, however. If you suddenly have a large down payment, the trustee can call you back in to ask where you got the money (on suspicion that you hid it from your creditors). It doesn't happen often, and if it's from equity in your home that was protected in the BK its even more unlikely, but it can happen so be careful.
