Paying back thru ch13

If one files (or trustee considers your 7 is to go to become a 13), how does the repayment plan work? Do you pay the trustee a check every month for whatever is decided..or do they garnish it from your paycheck? if the latter, can you tell them no, you dont want it done that way and just send it in?

I didn't have a choice. The first few months I sent a check and then after that it was deducted from each pay check. I never asked to not have it automatically deducted because I guess i just do what I'm told. It was actually very easy have it deducted, but very humiliating.

My understanding is the option is trustee dependent, but all trustees recommend it because it makes it less likely that you will miss a payment.  We chose not to, and our trustee allowed it.

I mailed in every one of my payments.  I told my attorney I didn't want my employer knowing... and the trustee was fine with it.

Generally, you can pay the trustee directly until you mess up too much...

Rebuild started in 2014  -  $100k unsecured credit in 2017  -  $500k unsecured credit in 2024.

DON'T WORK FOR CREDIT CARDS ... MAKE CREDIT CARDS WORK FOR YOU!

Thanks for the replies. I have filed ch7, but I'm just preparing for the worst(if it has to turn into a 13). The "worst" seems to be in my favor lately. Smiley Sad I would certainly want to send it in myself rather than cut out of my check. I would not want employer knowing about this bk, if at all possible.

We are permitted to send in our payments on our own. We just had our attorney tell the trustee it created a conflict of interest at my job. (I work in Finance). I think most of the time its okay, but I wouldn't miss a payment. They are quick to realize it.

I was never given a choice.  I was told I was going to just send payments to this address.  Then they informed me of the online payment instead of mailing it and bam!  Now I online pay and keep a copy of my online payments and Bank statements.

I would highly suggest having it paid through your checking account if its allowed.  I was told that all payments would have to be a cashiers check or money order if

I didn't do autopay.  So it saved me time at the bank, the post office and the stress of wondering if my payment was on time.

Luckily, I no longer have to question anything. I'm strictly CH7. Waiting on discharge.
