I successfully completed my chapter 13 over a year ago (5 year plan) and after my chapter 13 was discharged I disputed a few balances that werent correct and they were quickly remedied. Now... 2013 one of my creditors (truck loan) of which was paid/completed thru the plan ( title released) is now popped up with a balance showing. I'm stumped... Do I have to continue to buy current credit reports continue address these issues "every time they pop up"? Any help is appreciated...
frustrated....
Yes, everyone should check their credit once per year anyway. But after a BK you need to check more frequently because some creditors don't report correctly. It hurts you more to have a derog after BK. So, yes, contact that creditor directly to correct. If they don't, contact your attorney to have him contact the creditor. It is a violation of the discharge injunction for the creditor to report a balance due of discharged debt.
Well, I contacted the bank and after being transferred about 3 times, I finally spoke with someone who seemed eager to address the situation. The account was deleted and my fico score rebounded to its original spot at 680.
Thanks and also thanks to Bmo Harris for doing the right thing..
Congrats for getting them to listen to you!
By the way, I bet they were eager (the one that knew what he was doing) - its a huge violation and they could be fined heavily by the BK court for reporting balances on your CR after your discharge. Thank goodness you got to someone that listened to reason.
