questions about bankruptcy and apartment lease for college child

We will be filing Chapt. 7 (medical situation, job reduction). We signed for an apt. lease for our child who is a college student. She has helped to pay 1/2 but cannot afford the entire amt. My question is this. Do we need to move her out and include the 1 year lease agreement in the Chapt. 7? (we signed for alittle over $5000.00) Could we get her into a cheaper apt. before filing Chapt. 7 & then include it? Would this hurt her from getting another lease. We will be moving over an hour away from her campus so she would have to drive to college in this event if we let it go.

 

In regards to our home-we are not late yet but we intend to let house go. We are upside down in 1st/2nd mortgages. We were advised to stop all payments-house, cards, medical bills. Should we go a few months and then file to stay in home longer or file NOW? Our credit has taken some 30-60 lates but we got caught up by borrowing from relatives, etc. We cannot keep going with the debt. We will be 30 days late on mortgage Nov. 1. In other words, should we file not to salvage any scores?

 

Our daughter is first priority so please advise what we should do in regard to her situation. She told us she found a cheaper apt but we are under the lease where she is. She is 18 though and we are ONLY cosigners for the lease. I don't even know if we could include it.

read the lease breakage fine print to see what they can do.  If you file chapter 7 they won't go after you but they WILL go after your daughter if she breaks this lease.  See if you can figure out a way to get out of it. In many cases, apartments charge an upfront fee for breaking the lease.  If you talk to the apartment management you might be able to work out an agreement that will get your daughter off the hook.   If you are positive that you are filing, don't worry about your scores or paying anything.  Just pay for essentials.  You can recover from a chapter 7 in a few years.
