I will be relying on my insurance to subrogate the claim with a lawsuit if needed. My car was covered under a collision policy, so we are fine as far as money goes.

The way I imagine what you said is that the wheels dropped in a ditch or something on either side and the bottom of the car hit the tracks.

Kind of like this:

so you would sue the state for not properly marking the crossing?  or not maintaining the road?

Re: Garden Club Meeting - September 2012

I just got CapOne Rewards 1k, Walmart $500, and Barclay $500. Oh and a motorcycle 17K. HOw should I proceed for the next CLI? I want to garden how long before I try anythiing? I want to get my CLI up as high as possible and look for a house within a year or so (no rush but I'd like to take advantage of the current prime rates). That's my goal. Congrats on your limits! I am very impressed! Robot wink

Re: Garden Club Meeting - September 2012

The railroad has an estabished guideline for maintaining and inspecting at grade crossings, as well as making sure that tracks are properly supported from underneath. In this case, the track was not supported, it sank below grade and pushed the asphalt up. The railroad has a 20 ft right of way on each side of the track that must be maintained.

The car undercarriage struck the asphalt which had been pushed upward.

I deal with FRA compliance and my sister is a traffic engineer, we both agree that the railroad company is at fault for not properly constructing and maintaining the at grade crossing.

seems like i've had this bronze for a long time, but I've got over 2 full months before I'm swinging a silver.  Gardening takes forever!

EDIT:  no, im wrong.  I have a month and a few days.  It still takes a long time though.
