Paypal Credit - BML changes...

Have others received this yet?  Just changes in the T&C.. Bolded is what I have used before, guess they might be changing that loophole Smiley Happy, been sending from one paypal business account to personal paypal account..  Hopefully it remains hidden as it always has been.

 

The Lender for your PayPal Credit Account, Comenity Capital Bank, is making some changes to the Terms and Conditions of the PayPal Credit Payment System (“Terms and Conditions”). With this communication, you are being provided with a link to a copy of the updated Terms and Conditions and Privacy Policy that reflect the changes described below. The documents found in the link below will replace your existing Terms and Conditions and Privacy Policy. Please read this communication and the linked documents carefully and keep them for your records.

Part One

The following general changes are applicable to multiple Sections:

All references to www.billmelater.com also provide a reference to www.paypal.com for those customers who service their Accounts on www.paypal.com.
The Terms and Conditions were reorganized and/or renumbered for greater clarity and simplicity.
Other nonsubstantive changes were made throughout for greater clarity and readability.
Part Two

We made the following changes to the E-Sign Consent section of the Terms and Conditions:
Added “Disclosures” to the Definitions section: “Disclosures” means important communications and other information relating to your application for and/or use of PayPal Credit, including but not limited to agreements, privacy notices, billing statements and changes in terms.
Updated the “Consumer Consent” section to state, “We may alert you when the Disclosures are available, by sending you an electronic communication.”
Updated the browser requirements and email address in the “What You Will Need” section
Updated the “Legal Effect” section to make it consistent with the update made to the “Consumer Consent” section referenced above.
Part Three

The following summary briefly describes some other changes that have been made to the Account Agreement.
In Section 3 “TYPES OF PURCHASES AND TRANSACTIONS,” we updated the Cash Advance section to clarify that you may not use this feature to send money to yourself and any Cash Advance transaction may be declined if fraudulent or high risk behavior is suspected.
In Section 4 “YOUR CREDIT LINE AND OTHER AGREEMENTS,” we revised the language to provide that we may allow you to complete a transaction in excess of your available credit without increasing your Credit Line under certain circumstances (such as if you have a previous “non-sufficient funds” payment on your Account).
In Section 7 “INTEREST RATE AND INTEREST CHARGES” under MINIMUM INTEREST CHARGE, we added language to clarify that the $2.00 minimum interest charge will only be imposed in Billing Cycles in which you owe interest on Standard Purchases and/or Cash Advances.
We created a new Section 9 “MINIMUM PAYMENTS DUE,” where the Minimum Payment Due for Standard Purchases, Cash Advances, No Interest if paid in full Purchases, and Easy Payments are explained in one clear section. We also clarified that if your unpaid balance of Standard Purchases, Cash Advances and/or No Interest if paid in full Purchases is less than the amount calculated using the specified methods, the payment due will be that unpaid balance.
In Section 17, “COMUNICATIONS BETWEEN YOU AND US,” we clarified the situations in which you may receive an autodialed and/or prerecorded message call or text message and included the customer service number you should call if you would like to opt-out of receiving these types of calls or messages.
In Section 18 “GOVERNING LAW, FORUM” we added language to clarify that the laws of the State of Utah govern any claim or dispute that has arisen or may arise between you and us.
Part Four

The following summary briefly describes some changes that have been made to Section 19 “AGREEMENT TO ARBITRATE”:
Opt-Out Procedure – We updated this subsection to clarify that only new customers can opt-out of the Agreement to Arbitrate by mailing in a written opt-out notice to the address provided.
You and We Agree to Arbitrate Disputes Between Us (previously “Summary”) – We reorganized and restated this subsection for greater clarity.
Claims Subject to Arbitration – We clarified that common law and statutory claims are covered by the Agreement to Arbitrate.
Notice of Dispute – We created a Notice of Dispute form and provided a hyperlink within the Terms and Conditions for your convenience. We also updated the address where this form should be sent: Bill Me Later, Inc., Attn: Litigation Department, Re: Notice of Dispute, 2211 North First Street, San Jose, CA 95131. In addition, we reduced the timeframe you must wait to file an arbitration from 45 days to 30 days.
Costs of Arbitration – We decreased the value of relief threshold under which you would not be responsible for the fees associated with the arbitration from $75,000 to $10,000.
Severability and Future Amendments to the Agreement to Arbitration (previously Future Amendments to the Agreement to Arbitrate) – We updated this subsection and its heading to provide greater clarity.

Please refer to the above link for the Privacy Policy that applies to your PayPal Credit Account. The Privacy Policy was reformatted.
