My guess is that they won't approve with a judgement.....but I could certainly be wrong. FICO scores are certainly not a clear indicator of approval with AMEX -- many people with FICO scores over 700 have reported being denied.
This and AMEX takes into account alot of different factors as well:
-Payment history on other accounts
-If the Judgement is Pai you have a better chance (Mine was paid when they approved me)
-INQ's
-Prior history with other cards
-Teletrack report
so whether i take a shot now or months down the line even with a higher score, its quite possible this judgement if not corrected, would still cause a denial regardless of relationship with amex. so it doesnt matter if its a bce which is harder to get or something easy as a delta gold

An unpaid judgement is a biggie with AMEX. I would look into trying to get it off there if you can.
so im guessing they must have approved the charge card based on the CA they pulled initially which doesnt have the judgement like ex does.

Its possible. They are less stringent on the charge cards because they have more control over you with them.
so from what ive read on the forum, wouldn the same apply for the delta which apparently has the same criteria as a charge

No. Charge cards and Revolvers have ifferent criteria. The Delta is easier to obtain then their other more prime revolvers.

No. Its not a waste since it doesnt count against you. Its a waste if you dont app. Just app. I apped 4 times since january for the BCE and I finally got it this month.

Sympathy approval?
I don't think repeated applications is necessarily the quickest path to an Amex; personally unless I needed Delta specifically right now for a non-trivial transaction amount with said airline, I'd wait till January and take the backdating goodness.
