You may have heard there is language in our customer agreements stating we could potentially make “personal visits” to our customers.
As much as we would like to get to know each of our customers better, we don’t visit our customers at their homes or workplaces to discuss their credit card debt—ever. We never will and apologize if we ever made you think we might.
And if we need to call you—rest assured—we will never claim to be anyone other than Capital One when we make those phone calls.
Finally, we are reviewing our customer agreements to ensure we use language that more clearly represents our intentions. We can do better.

Those "Communications" terms are still in their credit card agreements, which are posted online.
When Capital One sells a charged-off debt, the buyer inherits these terms, according to the "Assignment" section of the agreement.
So the buyer's collector might feel empowered by the language allowing visits at home or work.
But does anyone know if such visits actually happen?
I would assume cap one would not waste the money or manpower to stop by someones house unles they owed them a hefty amount of money and had the means to pay but refused. If you are out of work in collections it is a lot different than making six figures and not paying.
Glad I don't have that card in my wallet. Not sure how I would feel if a credit card company came to my home. Seems like a lawsuit waiting to happen.
A Capital One representative just told me that new customers are now getting agreements with updated language.
Has anyone seen this and care to share it? I am trying to determine the extent of the update.
Existing cardholders will be getting the new terms in a while, according to the company.
Capital One now says it is revising these terms for general purpose cards but keeping them for store cards.
Keeping rights to call your cell phone, if you provide the number.
Here are the new terms in the "Communications" section of card agreements, and a link to the news article:
"You agree that we may communicate with you by mail, telephone, email, fax, prerecorded message, automated voice, text message or other means allowed by law regarding your Account. You agree that we may contact you at any telephone number (including a mobile telephone number that you provide us), and use an automated telephone dialing system or similar device to do so. You agree that we may monitor or record any conversation or other communication with you."
