My most recent letter to Mr. O'Donnell...
Mr. O'Donnell,
I spoke with a supervisor by the name of Tony today, EID 01806. He
stated that AFNI is currently requesting validation from Verizon
regarding this account and that it is in a pending, hold status.
I find this unacceptable, I have been disputing this account with AFNI
since it has been reported and AFNI has verified it multiple times.
Now, I am being told that AFNI never really verified the account?
After speaking wqith teh FTC I was informaed of the following "The
statute requires that the debt collector obtain verification of the
debt and mail it to the consumer (emphasis mine). Because one of the
principal purposes of this Section is to help consumers who have been
misidentified by the debt collector or who dispute the amount of the
debt, it is important that the verification of the identity of the
consumer and the amount of the debt be obtained directly from the
creditor. Mere itemization of what the debt collector already has does
not accomplish this purpose. As stated above, the statute requires the
debt collector, not the creditor, to mail the verification to the
consumer."
Why would AFNI collect on an item that has been disputed as fraudulent
and NOT fully verify it?
The damage this has done to my credit alone is worth suing over, not
to mention damages, and defamation of character. This has also caused
a great deal of stress, calling and sending letters constantly since
08/07. As I stated previously, I would be more than willing to remove
such grievances if this fraudulently opened account could please be
deleted from my credit bureau.
I am looking forward to an uneventful resolution to this situation,
and while I prefer to not use the courts to litigate, I will if
necessary.
