Ok here is the help I need my BF has 3 Cap One cards and I believe they total to about 3k originally, he went to jail for awhile and there was no way he could pay any of these items. We are now together and want to correct this ofcourse they are reported on his CR as owing more. I have DV and they all validate, 2 said these accounts were open over the phone, should I try to get more proof. He does not remember. What should I do. He paid his penalty for the crime now he is trying to get his life in order and just needs some advice. Any is appreciated.

Is Cap1 reporting the accounts as open?

Or have they been Charged Off?

Has a CA (Collection Agency) contacted you?

Is a CA reporting to the CRAs?

We need more info before we can advise.

Also check to see if there is some law that freezes debts while incarcerated..

Were his creditors informed prior to his jail time?

1st Cap One - Collection/Charge Off on all 3 CRA,

2nd Cap One - Same

3rd Cap One - Current for 2 CRA's Collection/Chargeoff for One CRA

4th Cap One  - Collection/Charge OFf on all 3 CRA's

I DV'ed all of these and only got back verification on 3, now what is my next step. Can I make settlement arragements for him. I say I because I am doing the work, since he is working to pay our current bills and I am a stay at home mom.  Anyway please help.

Did you DV Cap1 or the CA?

How old are these accounts?

Do you know if they are within or past the SOL in your state?

Ok I DV'd Cap One, The sent back verification there were 4 accounts and I received a response only from 3.

The DOLA for these accounts are around 7/2003.

The SOL in New York I believe is 6 years.

Do I DV the Cap One account that hasn't replied?

Also what is my next step. And do I settle for the amount that was verified or the amount they posted on my CRA's report?

Just an update:3/4 Were paid one was deleted because it was a duplicate repot. Thanks again for all of the help!!
