CA charging fees reporting to CRAs monthly

what can i do about a CA that is taking on fees monthly and reporting such?

Your statutory basis for challenging any amounts asserted to be part of a debt by a debt collector is FDCPA 808(1), whiich stipulates that it is a violation for any debt collector to attempt to collect any amount that is either not specifically authorized in the contract creating the debt, or otherwise permitted by law.

 

In the case of a CRA reporting fee, I highely doubt that your contract with the OC authorized such fees.

If it does not, then your state must have specific authorization entitling a debt collector to such fees.

Call your state agency regulating debt collectors and inquire as to whether they are permitted by law to such fees.

If not, they are in violation of FDCPA 808(1) for even attempting to collect such a fee.
