CA now calling my wife instead of me, after I told them not to call

My wife has an account that a collector is trying to collect on. I recently sent them a DV and in the DV letter I told them to stop calling me at any number that they had on file for me.

Are they in violation of the FDCPA since the phone number is in my name, and I told them not to call me, even though they're now trying to collect on a separate account for my wife?

Thanks in advance.

Re: CA now calling my wife instead of me, after I told them not to call

If a separate debt, IMO, they are not in violation. The purpose of their call is not for you, but for your DW. If the call was for you, then YES, definately in violation under Sect. 805 (c) for Ceasing Communications & Sect. 809 (b) for the DV for Validation of Debts.

Try sending a Cease and Desist letter referencing Sect. 805(c) on behalf of your wife.

Never send a C&D letter   unless it is past SOL and you are sure about it!!!!!!!!

The DV should simply say  do not call!  all communication in writting!

If the CA has the debt in her name.....did you send the DV in her name?
