Does anyone know the law on a change of address or if there any applicable cases to it, if a mailing went undelivered because of an address change or if the bill was sent to a wrong address and then went to collections? Any information or links would be much appreciated
I take it you notified the creditor ot a change of address, and they sent to the old address?
The legal requirmets are most likely what are specified in the terms of your account agreement.
Issues of receipt of paper billing will also depend upon whether you have accepted paperless billing as sufficient for billing notice.
If properly notified of a change of address, and they have not complied with the billing terms in your account agreementm, you have an issue of a billing error on their part.
If a credit card, the best way to address is by way of a dispute under the Fair Credit Billing Act (FCBA), which places substantial requiremets on the creditor.
Thanks a lot man, i'll read into the FCBA
