Back in 2001 I filed for my CH 11 BK. At the same time I was getting a divorce and trying to get back on my feet in a new apartment. I went 3 months late on a car payment (had been perfect up till then). My now SO gave me a loan to get the account current, and then I paid her back over a few months. I got some negative marks on my credit reports because it as expected.
Now I'm not trying to get them removed, I just want them reported correctly. Here is a quick rundown of how they are reported.
Experian has listed under the "seven year payment history" 30 days late - 1 time (Jul 2001). **note ** Experian is not 100% correct, but it works for me.
Equifax has, 30 days late - 1 time (Jul 2001), 60 days late - 1 time (Aug 2001), 90+ late - 1 time (Sep 2001) **note** Equifax actually has it reported correctly.
TransUnion has, 30 days late - 1 time (Aug 2002)
I disputed the account since they have the year wrong but TransUnion came back saying the data was confirmed.
I re-disputed the account with TransUnion, pointing out that the year was listed incorrectly and even suggested they change the notation to be listed correctly as 2001 vice 2001.
I wrote a nice goodwill letter to Chrysler Financial, admitted that I did indeed have a missed payment in 2001 but that it was being reported as 2002 and asked if they would either delete (goodwill measure) or correct the mistake. Got a letter from the gutless wonders yesterday saying, "We have investigated your account's history and have determined that we are properly reporting your account information to the Credit Reporting Agencies." It was signed Dave H. Credit Dispute Specialist. They are so gutless, they won't even give you the actual name of the person doing the investigation much less give you any contact information Some may wonder why I care so much about the year being correct. Next year at this time, all my baddies will be dropping off except for my BK. Well, that and this one incorrect account which will hang around for another year.
What should I do? Should I sent the super serious "fix it or I will contact my lawyer" letter? Should I send them copies of the Chrysler Financial section of my other credit reports to show them the error of their ways? The really sad part is that in Nov of 2002 I traded in that car and bought a new car so the loan was paid off in full, but this entry makes it look like I just skipped a payment a year and half after my BK which is not good. Why can't these people just do their jobs correctly?
