Collection Item Over 10 Years Old

Hi, I'm receiving collection letters for a debt that is approximately 10 yrs. old.  I never received any calls or written communication regarding this debt.  Then around April 2007 I started getting calls.  I disputed this debt in April 2007 and I hadn't heard back from the CA.  Yesterday I received another letter for the same debt from another CA.  It seems the first CA sold it to the 2nd CA.  I've gotten my credit reports from all three agencies and this debt is not listed.  The SOL in my state is six years.  What should I do?

You can always notify them in writing that you realize that not only is the debt past the SOL but past the reporting limits under the FCRA. I would also notify them in the same letter that I no longer wished to be contacted in the matter as well as an intent to sue if the debt is reentered into your credit files.
 
Welcome to the world of zombie debt, keeps rising from the dead.  Rememebr as long as they bought it they have a right to attempt to collect on it but past the SOL and reporting period, you have no obligation to respond.

The Rules Of Civil Procedure of my State of (State ) provide a Statute Of Limitations limiting the time frame for any legal collection activities.

Please be advised that under the TILA § 15 a credit card account is legally defined as an "open" account.

The Act is in Title I of the Consumer Credit Protection Act and is implemented by the Federal Reserve Board via Regulation Z (12 C.F.R. Part 226).

The Regulation has effect and force of federal law.

Open-end Credit Transactions:

Open-end credit includes bank and gas company credit cards, stores' revolving charge accounts, and cash- advance checking accounts.

Typical features:

Creditors reasonably expect the consumer to make repeated transactions.

Creditors may impose finance charges on the unpaid balance.

As the consumer pays the outstanding balance, the amount of credit is once again available to the consumer

(5)  The threat to take any action that cannot legally be taken or that is not intended to be taken.

Thank you so very much for the responses.  I really do appreciate the information.  It just drives me crazy that having worked so hard to clean up my credit (my FICO scores are in the 700 range for all three CRAs) that something like this comes up and after so many years.
