Re: Complicated question

Letter states, that they received the info from the other 2 cra, and so they did an investigation also, and discovered that it was a fraudulant account, so they also deleted it.  Letter lists the account name and account number, also got the deletion letter with the account name and number

Re: Complicated question

Unfortunately for you, when you're trying to set aside a judgment, you have a couple of hurdles. First, you need to file your motion to set aside quickly. After thirty days, most courts will lose jurisdiction to set aside a judgment even if you have compelling evidence. the judge simply doesn't have the ability to enter an order unless it has jurisdiction. There will be some process to set aside a judgment after that time, but in most cases, that will require you to give the court a good reason as to why you didn't come to court to dispute the account before the judgment was entered. In order to get a judgment, LLNV should have been required to prove that you were properly served with notice to come to court. If they failed to provide that, or if it is wrong, then the court never had jurisdiction and you can set aside at any time. If you were served and you just didn't go to court, you may be too late to present even the most compelling defense. You need to act ASAP if this is a recent judgment.

Re: Complicated question

Gather up everything you have on this, including but not limited to printed copies of your CRs, letter stating fraud, copies of investigation results from the CRAs, all letters from the CA, anything you received from the court.

Then talk to a lawyer. Look on naca.net or myfaircredit.com

Find one near you, give 'em a call. Try to have about a 30 second blurb ready to spit out. Have more details in a longer 1 to 2 minute blurb. You might get a legal secretary, might get a paralegal, might luck out and get a lawyer.

That letter from the CRA stating fraud, IMHO, is a "smoking gun" the lawyer is gonna wanna see.
