Dynamic Recovery Solutions and a pay day loan that I did NOT obtain.

 

Hello All!

Dynamic Recovery Solutions send me a letter stating I owe them $442.64 for a pay day loan from quikpayday.com.

 

1. I DO NOT take out payday loans.  I attempted to research the pay day loan company but it doesn’t exist.  

2. I am freaking out!!!!! How did this company get my information? I have read several comments about this collection agency sending collection letters to people who never even had accounts with the original collectors.

 

 

I would like to know how to handle this. I, of course, will be sending out a debt validation letter but I pretty sure I will not receive anything in return. What should I do after that? Has anyone else experienced this before?

Fill out an FTC Fraud Affidavit and file a police report.  Send those to the CA and ask for all documentation.

 

Looks like it could be fraud,

It is a practice of some debt collectors to initiate collection without sufficient documentation that clearly pegs a debt to the corrrect consumer.

They might, for example, obtain a listing of names of consumers in an area of the last known address of a debtor, and make a best guess.

 

That is the primary reason for the dunning notice and DV process..... to provide consumers the ability to obtain additinal information abuot the source and amount of an alleged collection in order to evaluate its legitimacy.  Until the debt collector states that they have investigated and obtained verification, they must cease collection on the debt.

 

As suggested, if a consumer can make the good-faith statement that they never authorized an account or had a debt with an alleged creditor, and are willing to put that assertion into a sworn police report, the FCRA requires that information to be blocked from their credit report.  FCRA 605B.

 

Additionally, sending a DV won't require the debt collector to provide supporting documentation should they verify, so the FCRA identity theft process also includes the provision that the police report can be sent to the creditor, who must then provide all business records pertaining to the opening and use of t he account, and the consumer can also send a copy to the debt collector, and obtain any information that they would normally be entitled to if they had disputed the debt under any provsion of law.

 

If, after obtaining more information, you can conclude that the debt collector is acting without adequate basis, you can file a formal complaint with the CFPB or initiate your own legal action against them.

Update: I contacted Dynamic Recovery Solutions and the rep stated it was a pay day loan from 2005. I informed the rep that it was not my account, I do not take out pay day loans, and 2005 is past the SOL to collect in my state. I stated I would like for her to send me all documentation concerning this debt to me via mail. I also stated I would mail this request. The rep stated she could not send me any information because she does not have documentation that the current owner of the debt has the information. So I then contacted the owner PMD Financial Group. I spoke with a rep and he stated that that he does not have any information about the debt. He was informed that quikpayday.com (the company they claimed I used for a loan) does not exsits. He stated he would delet my file from his and DRS records. I am still sending a DV letter. I am reporting each company to the BBB. 

 

 

Is there anything else I should do at this time?

Quickpayday never existed or no longer exists? 

 

It is too old to be on your CR but I would still monitor to make sure it doesn't somehow show up.

 

I would also report them to the FTC.

quikpayday.com never existed. The PMD Financial Group (current owner of my debt) even did a search themselves and could not find the company. It's crazy to me how they can just request money and they don't even have any information about the original creditor. After researching PMD and Dynamic Recovery Solutions this is a common occurrence. They have done this to many consumers claiming they owe pay day loans, amex, or capital one. When the consumers contact the original creditor, the original creditors confirm that consumer NEVER had an account. CRAZY! I'm not sure how the CA got my information.
