First to worst with one medical/insuanace bill!!!!

Please help answer some very confusing questions for me!! I have always maintained perfect credit. I was in a car accident a year ago. The Brazos Emergancy Physicians Association was very difficult to work with. All of my other bills were paid by USAA insurance and the rest turned over to United Health Care. United Health Care had troble getting the proper cpt codes from BEPA. I made several calls and documented time, name of person spoken with and what was said. I even involved Resolution specialists from UHC on two or three different occasions. My son's bill was paid with no problem. This company turned my $325.00 bill over to collections without so much as a warning, UHC called them and got the cpt codes over the phone finally because I was so frustrated with them. The bill was paid in full 12-12 07. I thought medical bills couldn't be turned over to collections? Should I hire an attorney over a $325.00 bill. From what I can read this will stay on my credit for 7 1/2 years! I am a single mom who has worked very hard to always stay on top of finances. This is a very devastating blow for me. I am writing a letter of complaint to the hospital that contracts out this service. Can you please give me some advice in which to turn. I have just tonight disputed it with equifax. I am also going through a divorce ad refinancing my car and a tine share I got stuck with is really sending those rates through the roof also. I just have never experiences any of this!! Could you please advise me??????????????????????????xxo I mean my credit went all the way down to 650!!! Please help???????????????

Medical bills can be sent to collection.  They just usually are not listed on the CRs with a name.  Instead of getting an attorney, just first see whether you can make payments and if they will agree to delete the reporting upon payment.  My understanding from reading the boards is that most medical bills are some of the easiest things to have removed when paid.

Welcome to these forums...and sorry you're going though this.

I don't know enough to comment on medical collections, but they are a different game due to HIPAA regulations. Search around. There's some good success stories here. You probably don't need to hire an attorney.

Re: First to worst with one medical/insuanace bill!!!!

I have at different times found medical collections on my report.  If you contact the CA, they we usually  take it off with full payment.  I understand your issues.  In the years 04-06, my family had over a $1MM in claims.  It is hard to keep track of everything between the hospital, doctors and insurance companies pointing fingers about who is responsible.  They also are notorious for dumping bills to collections without telling notifing you.

Just make some calls to the CA and OC and you should have no problems getting it off your CR

Re: First to worst with one medical/insuanace bill!!!!

I have this situation now and the CA refuses to do anything.  I have asked for full validation and gotten nothing.  I have offered a pfd and they typed a note on my original letter and returned it.  I am collecting the documentation now to take them to court.

Re: First to worst with one medical/insuanace bill!!!!

I would call the OC.  I had quite a few issues with a few CAs, doctors, etc., but the Hospital intervened to help resolve.  My situation maybe different because we had a case manager from the hospital and insurance to manage both mine and my childs case at the hospital due to the size of our bills.

You asked for a DV and they sent you nothing???? That is in of itself illegal - you have the right to have evidence of such debt. Did you dispute/dv through the CRAs?

The $325.00 bill was paid but a CA is still trying to collect? I may not be understanding the situation.

Please be advised that under Federal Statutes. the Fair Credit Reporting Act, (15 U.S.C. § 1681 et seq)and (name of your State)'s Consumer Credit Statutes, you may be held liable for the actions of (collection agency name).

(a) Duty of furnishers of information to provide accurate information.

(1) Prohibition.

(A) Reporting information with actual knowledge of errors.

A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or consciously avoids knowing that the information is inaccurate.

In addition, the HIPAA and (name of your State)'s Medical Privacy Statutes are in effect in this situation even though the health care services you provided may have been prior to enactment .

The Privacy Rules prohibits a covered entity from using or disclosing an individual's protected health information ("PHI") unless specifically authorized by the individual or otherwise allowed under the Privacy Rules.

In general, PHI encompasses substantially all "individually identifiable health information" that is transmitted or maintained in any medium. "Individually identifiable health information" includes health information that is created or received by a health care provider, health plan, employer, or health care clearinghouse, and that relates to an individual's physical or mental health or condition, including information related to an individual's care or the PAYMENT for such care.

You are required under the FCRA and FACTA to accurately report the status of any account to the credit bureaus, and you are prohibited under the HIPAA and State privacy regulations from doing so on a PAID account, as there is no longer any permitted business purpose.

Therefore I am requesting you promptly rescind all such account information furnished to (collection agency) and require them to purge their records of all reference to this account, and that you insure that any and all reporting of this account is immediately deleted from my credit reports.

This simple procedure to request the deletion of ALL reference to this account from the records of ( collection agency name) and to require them to have this account information deleted in its entirety from my credit reports will resolve this problem completely.

Please respond, in writing within 10 days that you are processing this request.

I am reserving the right, to take appropriate legal and civil action including reporting to any applicable regulatory authorities any lack of cooperation or compliance with this request.

I hereby waive my rights under HIPAA and any State Privacy Act for the single purpose of your transmission of this request and accompanying documentation in any required report you must make to your E &O insurance carrier.
