HELP!!!!! Request VD from a NCO-MEDcl and now law firm inquiry on report!

I disputed with a NCO-MedclCA who reported a medical bill on my credit report.  After receiving my letter they removed it within 5 days.  Then I received a notice from NCA saying they now own the debt but it didn't appear on my report.  I sent them a dispute letter as well over 45 days ago with no response.  After checking my report I now see a law firm has requested my credit report and I think they are going to try to sue me.  What is the best course of action to prevent this from hitting my credit report.  HELP!!!!!!!!!!!

Firstly, request DV, not VD.  Sounds like NCO sold while under DV.  Violation.

DV this NCA, CMRRR

Did the CRAs remove?  Send copies of everything to them and ask for the removal.

Send a non-authorized inquiry letter to anyone who is pulling your reports regarding this.

File AG, FTC and BBB complaints on all.  Consider reporting the attorney's office to the State Bar Association too.

Go to www.naca.net , you may need a lawyer to handle this and sue them for violations.  Document everything and keep copies of each report you pull.

I really recommend naca.net because I also see this looks like a medical collection.  This potentially also violates your HIPAA rights.

Monitor your credit reports regularly for NCA to report.  Daughter received NCA (National Credit Adjusters - Kansas) letter September '07 for a bogus Payday Loan.  They too, had not yet reported.  DV'd the CA within 30 days and they never responded.  But, come last week (5 months later), guess what pops up on credit report?  NCA!  Complaints were filed immediately with WA-AG, FTC, BBB, as well as TU.

What is you SOL     what is the DOFD or DOLA     Some CAs hide behind an attorney's name OR the attorney might just do collections  they are treated the same as a CA.  Send them a DV  CMRRR

Check your state law  do CAs have to be licensed?  are they?

If you are sure that they did a HARD pull & not a soft one   send this letter to them along with the DV

DO NOT SIGN EITHER    just type your name     make changes where needed

To Whom It May Concern:

I have noticed that you have placed an inquiry on my _________ credit file dated ________. As you probably know, Credit Reporting Agencies treat inquiries as a statement of fact and will not allow a consumer to dispute them. Since it is against federal law (Fair Credit Reporting Act -- 15 USC § 1681n(a)(1)(B) for an entity to view a consumer’s credit report without a "permissible purpose," I am writing to inquire as to your alleged purpose for doing so since I did not apply for employment with your organization nor did I request credit from your organization.

[Describe any additional details about the inquiry here if need be. For example, your a subscriber to XXXX monitoring service and XXXX company pulled a "hard inquiry" on one of your reports.]

Based on the evidence in my possession, this inquiry was performed under false pretenses as described in the clear language of the law. 15 USC §1681n(a)(1)(B ) states, in part, "in the case of liability of a natural person for obtaining a consumer report under false pretenses or knowingly without a permissible purpose, actual damages sustained by the consumer as a result of the failure or $1,000, whichever is greater;"

You are civilly liable to me in the amount of $1,000.00 for your willful violation of the law -- performing a "hard inquiry" on my __________ file without my permission. I do hope that we can settle this matter amicably. You can remove the inquiry within one (1) business day of the receipt of this notice. Or, we can meet in court where you will end up removing the inquiry, paying me the civil liability fine, punitive damages for my score drop, plus court and attorney fees. The choice is up to you.
Please contact me immediately at the address listed below.

Sincerely,

Consumer
