Having late payments removed from my CR

I have 45 - 90+ day late payments listed by one of my creditors. They charged the loan off in June of 2004, but have been reporting every month since then as 90+ days late, which gives the impression that I have been getting statements every month and then not paying them. I have not received any statements since 2004. This looks really bad on my credit report. Can they do this?

If they are reporting correctly, then yes they can...and should do that. By law, when they report your account history to a CRA they have to report correct and accurate details of that account.

If what they are reporting is inaccurate however, you should dispute those inaccuracies.
