I sent PFD to Capital One

I sent a PFD to Capital One about three weeks ago. Strange, I got a call from West Asset Management today. They have the account. They are the fourth company that has had the company.

So one of two things probably happened. Since I am disputing this with EQ, there is a possibility that EQ has contacted them to verify my info, or Cap One forward my PFD letter to them. West Asset Management (WSM).

They contacted me today and wanted to know if I was willing to settle my debt with Cap One. I explained to them that I was wiling, and that I had sent a PFD letter to cap one. They told me that Cap one probably didn't get it or discarded it since the account wasn't with them any longer. I ask her if they purchased the loan, she said know, but that they were the fourth company that Cap one has sent it too for collections. I told them the only way that I would settle was for a letter from Cap One on their letter head that they would immediately delete my files with the three crs's as soon as they received my funds by certified payment. They told me they could only show it paid in full and I said no, They told me to contact Cap One and discuss our conversation. I spoke with three people at cap one, each one couldn't pull up my old account and said they would have to put me on hold to transfer me to a accounts specialist. Each time I would lose a connection with them on hold. Finally I did get through to someone else and she took my information and transferred me back over to WSM. DAH!!

So I am wondering....does cap one still have this account, it has been passed around to the fourth company. Should I wait to see what EQ comes back with. If EQ couldn't get through the tangled mess to verify the information, then they have to delete....Am I correct?

Re: I sent PFD to Capital One

When I was having my issues with Cap1, their CSRs and supervisors also couldn't locate the information on my account.  They do however have a credit disputes department that was able to access the information pretty easily, so I wouldn't count on them not being able to verify the information.  Perhaps send West Asset a PFD letter?

Re: I sent PFD to Capital One

I requested that of West Asset Management. But they said they were not in the position to make that kind of deal. They said I would have to get that from Cap One.

WAM said they could only settle up with me and list it as being paid in full on my CR's. I don't her I just couldn't go that route. That I have to have a Full Deletion. I explained to her that it was a win-win situation for all concerned. I said they get their pay from Cap One for collecting, Cap One gets paid, and I get it deleted from my CR's. That way every one wins. I explained to her that it has hurt me for the past five and a half years, and it would just have to hurt me another year and a half same as it would hurt evry one else involved-no deletion-no paid settlement.

They clearly understood that I knew my bounderies and legallity, and the SOL, That helped me alot thanks to the forums. After a few minutes they would call me back with a beter and better offer. But I still stood my ground-no deletion-no settlement paid. They we very polite, and after the third phone call, I knew then that the ball was in my court.

There was someone else that she was going to talk to, but they were out, but she told me that she would call me back once she got a chance to talk with her. But I have been on the internet and we don't have DSL where I live. I fell pretty sure she will want to call be back in the morning with beter news. Hopefully...I'm not going to count my chickens until the eggs hatch. But I got a pretty good ideal, they are really wanting to work something out with me. But it will be in writing, immediate PFD with certified funds or nothing. I got nothing to lose, but they do.
