Inquiry Removal?

Is it possible to get an inquiry removed if you were told it was going to be a SP and it wound up being a HP?

I don't trust the information that I get from Orchard Bank. The first rep said soft pull for CLI's then the second rep said it's a hard pull.

So I'm wondering if there is any way to get inquiries removed from your CR due to misinformation?

Its all in the fine print. If it was written, or maybe clearly stated on the website, then no, you can not, and should not file a dispute, especially if you just want it removed. Thats unethical. If it was spoken to you by a CSR, I highly doubt they would remove it. I have even had trouble getting unauthorized inquiries removed.

I called Orchard to inquire about a CLI, and the first rep told me it was a soft pull to request a CLI, so I said sure, go ahead... Then I called back (because I just had a funny feeling I don't know why) and I told the rep that I just requested a CLI and was wondering if it is a hard pull or a soft pull, and she said it would be a hard pull. I told her that the rep from the previous phone call told me it was a soft pull, that's why I requested it. Then I asked for a supervisor who told me it was a soft pull... But I am still not well with the fact that I was told it was a hard pull period.

So I am wondering if it does end up showing on my report as a hard pull, do I have a chance of getting the inquiry removed because I was misinformed?

Wow. That place sounds like a zoo. You could always call their executive offices(?) And see if you can get it cleared up there. Or possible call the buraeu and explain it to them.

Neither the FCRA nor the credit reporting manual address the distinction between a so-called hard and soft credit inquiry, other than those made only to obtain a consumer's name and address to offer them promotional, pre-approved offers for credit.

 

I have absolutely no idea how a creditor who has a legitimate permissible purpose to pull your CR that is normally of a type that qualifies for CR inclusion, such as those for consumer-initiated requests for credit or insurance, or with respect to legitimate business purposes, report them to a CRA in a manner that shields them from CR inclusion.

 

If they are of a type that meets the definition, I dont know how the inquiree instructs the CRA regardling its CR inclusion, or is permitted to do so by the CRAs,

Maybe codes that say...consumer initiated request for credit, but dont record it as such?

Not knowing how it is even done, I dont know how a consumer can contest it.

 

Disputes over credit inquiries are such a time consuming and troublesome issue that the credit industry was able to persuade regulators to totally exclude all issues related to credit inquiries in the final rulemaking at 16 CFR 660.4 governing the direct dispute process.  You cannot dispute directly with the inquiree.

Um....after years and years with Household Bank/Orchard Bank, I've NEVER seen a CLI request equate to a hard pull...although every CSR has warned me that it "could" be.

 

I wouldn't worry about it unless and until a hard inquiry shows up.  :smileyhappy:

I did a CLI request with Orchard about 4 months ago.  I was denied, but I did not have a hp inq show up.

Honestly, majority of the reps for these companies don't know the difference between a hard and soft pull.  Whenever anyone requests credit, know there's a chance it's going to be a hard pull, period. 

 

Now, OP, you of course can contact Orchard's higher ups and have them review the recording of the call and maybe they'll remove it.  But they don't have to.
