I took this from one of Hippy's posts, and shortened it a bit. Too much maybe? I know you said only use statutes if I have to, but I really REALLY don't want to have to dispute it twice. I have a tight budget lol so I wanna get it right the first go 'round
This is a request for deletion of a disputed item. I have attempted to have this alleged debt verified by the collection agency that is reporting it, to no avail. I respectfully request that (CRA NAME) delete the account listing.
On 03/03/08, LVNV received a demand for validation from me. Attached is a copy of that letter along with the U.S. Post Office return receipt. As of today, 04/07/08, they have failed to provide any proof or respond in any way.
The FDCPA states they must cease collection activity until they have produce validation of the alleged debt if so requested. As per the FTC, this includes the continued reporting to the credit bureaus without having validated the debt, and is a violation of the FCRA. If the proof of this debt existed, LVNV had an obligation to produce that proof when I requested it; yet they have not.
As per the FCRA §611(a)(5)(A), if no proof of debt exists it may not be reported to the credit reporting bureaus. The FCRA§ 611(a)(4) also states that the credit reporting agencies must accept written proof from the debtor. Therefore, I am not asking for an investigation to be done, I am requesting that the entry be deleted in its entirety as there is no proof of its existence as evidenced by my attached documentation.
