LVNV DV timeframe is almost up...

LVNV DV timeframe is almost up, Monday is day, technically Sunday is but there's no mail Sunday lol
 
My question is that once LVNV got the DV they let the CRA's know the debt was disputed, so it's still showing in Dispute status across the board on my TC reports as follows:
TU - Collection Account, Account info disputed by consumer, meets FCRA Requirements
EX - Customer disputed account - reported by subscriber.  Account seriously past due date/account assigned to attorney, CA, or credit grantor's internal collection dept.
EQ - Consumer disputes this account info Collection Account
 
So once they fail to respond, assuming the mail doesn't arrive on Monday with something from them, what is my course of action.  If it's already showing disputed can I dispute it myself again or do I have to wait for the disputed descriptions to go away?  Or should it just go away on it's own? 
 
If I do dispute it, should I just file a plain vanilla dispute saying not mine or do I absolutely have to send in a copy of the letter and a dispute letter to the CRA's letting them know I requested validation and did not receive it?

you can file a dispute........send the 2nd DV  CMRRR....... IMO you would dispute with all copies of GG  Cert paper and copy of DV letter
 
you can do both at the same   dispute & 2nd DV

Hopefully disputing that with EQ won't restart the DOE dispute I have running with them already... they're so slow for me grrr

I have the second DV already typed up for another company Smiley Wink just gotta make some minor changes. 
 
Is there a specific style of letter to send to the CRA's?

CRAs   short & to the point.  Use statues #s only when needed........keep in mind that CRAs have no idea what a DV PIF PFD or any of that means    you have to spell it out for them.

I took this from one of Hippy's posts, and shortened it a bit.  Too much maybe?  I know you said only use statutes if I have to, but I really REALLY don't want to have to dispute it twice.  I have a tight budget lol so I wanna get it right the first go 'round Smiley Wink

This is a request for deletion of a disputed item. I have attempted to have this alleged debt verified by the collection agency that is reporting it, to no avail. I respectfully request that (CRA NAME) delete the account listing.

On 03/03/08, LVNV received a demand for validation from me. Attached is a copy of that letter along with the U.S. Post Office return receipt. As of today, 04/07/08, they have failed to provide any proof or respond in any way.


The FDCPA states they must cease collection activity until they have produce validation of the alleged debt if so requested. As per the FTC, this includes the continued reporting to the credit bureaus without having validated the debt, and is a violation of the FCRA. If the proof of this debt existed, LVNV had an obligation to produce that proof when I requested it; yet they have not. 

As per the FCRA §611(a)(5)(A), if no proof of debt exists it may not be reported to the credit reporting bureaus. The FCRA§ 611(a)(4) also states that the credit reporting agencies must accept written proof from the debtor. Therefore, I am not asking for an investigation to be done, I am requesting that the entry be deleted in its entirety as there is no proof of its existence as evidenced by my attached documentation.
