National Credit Adjusters - FTC & AG Complaint submitted

I thought some of you might enjoy reading the complaint I just filed with the Washington State Attorney General, FTC, BBB Kansas:

 
National Credit Adjusters LLC is not a licensed collection agency in Washington State.

The alleged debt was disputed and validation requested within 30 days of receipt of National Credit Adjusters collection notice dated 09/12/07.  Reference USPS Certified Mail, Return Receipt Requested, Tracking Numbers 70071490000330574033 and 70071490000330574064.

National Credit Adjusters LLC illegally resumed its' collection activities in February 2008 by reporting the alleged debt to TransUnion without providing validation.

National Credit Adjusters LLC has not provided the name and address of the original creditor as requested in the above referenced dispute letters dated 10/09/07.

National Credit Adjusters LLC misrepresented and incorrectly reported the name of the Original Creditor.  In its collection notice dated 09/12/07, National Credit Adjusters identified the original creditor using the term "No-Faxing-Payday-Loan" rather than providing the name of the
original creditor.  In its reporting to TransUnion, National Credit Adjusters again identified the original creditor using the term "No Faxing Payday Loan Com" rather than providing the name of the original creditor.
 
National Credit Adjusters LLC has not provided proof that the alleged debt is owned by or assigned to National Credit Adjusters.  Proof of ownership and/or assignment of the alleged debt was requested in the above referenced dispute letters dated October 9, 2007.

National Credit Adjusters LLC disclosed and allowed public access to my Social Security Number by using my federal social security number as the account number reference when it transmitted data to TransUnion in February 2008.

National Credit Adjusters LLC disclosed and allowed public access to my Social Security Number by using my federal social security number as the account number reference in its written coorespondence dated 09/12/07 sent via regular USPS mail.

National Credit Adjusters is also doing business as International Financial Services, Inc.

National Credit Adjusters is also doing business as International Homes & Financial Services.

National Credit Adjusters LLC is misrepresenting its contact information.  National Credit Adjusters used the addresses of International Financial Services - P.O. Box 550, Hutchinson, KS 67504 when reporting its contact information to TransUnion in February 2008.  The contact address National Credit Adjusters provided to me in their 09/12/07 written communication is P.O. Box 3023, Hutchinson, KS 67504.  The contact address registered with the Better Business Bureau is 300 N Madison St., Hutchinson, KS 67501.

The contact telephone number 620-665-7708 National Credit Adjusters reported to TransUnion is answered by International Homes & Financial Services.

To resolve this complaint, I am seeking the following:
Complete deletion of this alleged debt from my credit files.  Copy of letters from National Credit Adjusters to the Credit Reporting Bureaus (TransUnion, Experian and Equifax) requesting immediate deletion of this alleged debt from my credit files.

Letter from National Credit Adjusters acknowledging that they are unable to validate this alleged debt. 

Letter from National Credit Adjusters agreeing that they will not disclose my non-public personal information with affiliates or other third parties.

Complete purge of my personal information from the files of National Credit Adjusters, their affiliates, partners, third parties who performed services on their behalf and those with who they have a joint marketing agreement or those who assisted in maintaining my account.

Keep us posted!  You won't receive a personal reply from the FTC, but if enough people complain about the same company they may investigate.

I've been really nervous about reporting to AG and FTC for some reason. This letter gave me a nice template to work off of and now I just might do it!!

No need to quote laws, statutes, violations, etc...as this just wastes space and these are the folks who determine what violations were made and what actions to take.  For example, the BBB had so many complaints about ER Solutions last year that they revoked their membership in Washington.
 
The Washington AG online complaint allows 7000 characters, FTC allows 2000 and the BBB allows 4000.  Thus, you'll need to edit for each agency or breakup your complaint into 2 or more separate complaints.  Use MS Word to compose the body of the complaint (to get an accurate character count), then just copy/paste into their online complaint form.

This was very helpful, thank you. I bookmarked this page for future reference. This company recently showed up on my credit report and I had no idea what it was for. I started researching National Credit Adjusters, none of the information about them was very nice. I have never been contacted by them, have never used a payday loan place, and consistently pay all my debts, on time. I am not sure what is going on, but I plan on doing everything I can to correct it. Because of them, one of my creditcards went from a $4000 limit to $100, and I didn't even owe anything on the card, it had a Zero Balance! It's wrecking my credit score.

I also filed a complaint about National Credit Adjusters with the FTC this morning.  They keep calling my work and harrassing me.  I have requested that they stop calling my work but, they call every day.  Now, I just say don't call this number and hang up on them.  They have not even tried calling my home or sent any documentation to me.  So I went on-line and filed a formal complaint against them and the FTC assigned it a case number.  Let's see what happens.  Meanwhile, I will just keep telling them not to call my work, keep track of the dates, and hang up on them.
