Hi everyone, I have an unpaid judgment that was filed May 1, 2003. I had signed a contract for a gym membership. Shortly thereafter, I was transferred to another state for employment, which was a great thing because I was in a really bad living situation and my job caused me to travel on the road a lot. I had to pull everything together quickly to move to another state. I sent a letter to the gym explaining my situation, asking to break my contract because I was moving out of state, which I believed was a provision in the contract. Now... I have learned a lot since then... such as send everything certified mail, return receipt, keep records of correspondence, etc.
I do not have a copy of my contract nor did I send my original letter certified. Years later, I find out there is a judgment on my credit report. I never received any information regarding a court date and of course my old roommate did not bother to contact me to let me know of any summons.
I would like to take care of this item... is it worth sending a letter to the owner of the gym asking for the opportunity to pay in full and if they'd be willing to vacate the case with the court so the judgment can be dismissed and come off my credit report? Thoughts?
