My credit took a nose dive in 2004 (divorce). I have since paid off all of my debts. Whoopee!! I'm in the process of writing some GW letters to have the tradlines removed. My last hurtle is a car repo from Bank One (now Chase) for $8000. The account is now with Liberty Point for $11000. I offered to settle the debt for 1/2 of the original balance, $4k. The CA refused my offer stating $8k was the smallest amount they would accept. I requested by phone (silly me) for VOD. They stated they could not give it to me. My next recourse is to submit this request in writing, however the debt is greater than 30days, but since the amounts don't match and the CA states they don't charge interest, I'm thinking they don't have the records. Especially since Bank One is defunct. What are my chances in a case like this? I disputed this charge with Experian and the Experian rep told me that they don't request proof in writing, they go based on the CAs word.Any pointers. I'm totally new to this and need help.
Hopefully some of the other friendly mods will be around soon. Ok, the bureau rep gave you the right info, they simply verify what the CA tells them electronically. When the bank went out of business, do you know the name of the creditor the account were sold to? you said you already requested the DV if you are going to try and request it a second time, be sure to reference the first effort on your communication.More than anything, not knowing the SOL in your state, that is a judiciary amount if I ever saw one. Protect yourself and do what you need to do now!!
