Upcoming call with BofA re: new account problems

I will post the timeline of events below...

 

7/1 new CC with BofA established.

8/09 first charge

10/01 first payment due

10/15 payment 4x minimum / late charges and fees reversed, system error

12/26 payment 10x minimum  

 

bofA reports

30 days late NoV

60 days late December

 

EX appears to be  reporting OK for Jan,

no updates with other buros.

 

ive been challeneged by their online account setup, 

It seemed as though at first I was seeing information from another account, and

eventually during the 10/15th payment technical support made me set up an

account again because of the database crossover importing information that

it should not.

 

obviously, im really upset about the 60 day lates. 

 

Is there any guidance that a hay a kind individual would be willing

to share with me as to how best to go about my upcomming

discss with customer support?

I would recommend a dispute under the Fair Credit Billing Act (FCBA), which permits a more substantive dispute process for credit card billing issues, but has a timeliness requirment of no later than 90 days from date of the billing.

I must be looking at this wrong. It looks to me like your first payment was due on October 1 and you didn't pay it until October 15? Then you didn't make another payment until December 26. So aside from the fact that it was late, if your first payment was due on 10/1 then I would think you had to make another payment on or about 11/1 and 12/1. Am I reading that right, that you only made one payment between October 15 and December 26?

I must be looking at this wrong. It looks to me like your first payment was due on October 1 and you didn't pay it until October 15? Then you didn't make another payment until December 26. So aside from the fact that it was late, if your first payment was due on 10/1 then I would think you had to make another payment on or about 11/1 and 12/1. Am I reading that right, that you only made one payment between October 15 and December 26?


Wouldn't there also have been a billing statement due on 09/01 if 1st charge was on 08/09? 10/15 payment wouldve covered bill due 09/01 and then 10/01 bill was not paid til 12/26....so as of 11/01 the 10/01 bill was 30 days past due and 60 days as of 12/01. That's the only way I see how that 30 and 60 days past due could've been reported. And no mention of 11/01 bill being paid yet. Unless the account was brought current with that 12/26 payment, another derog may be reported again.

I bank with BofA and I pay all of my BofA credit cards online, as you do. I'm confused by your inability to pay your bills on time. Without fail, I have received emails from BofA letting me know when my statement is cut, and when my credit card bill is due. I pay, in full, immediately after the statement cuts. There has been only one time, in ten years, where I have forgotten to pay my credit card immediately. The thing is, they sent me a warning email letting me know that I hadn't paid my cc bill. Have you set up alerts on your online cc account, to make you aware, should you forget to pay? If not, you should. In the final analysis, the responsibility of paying your bills is yours, not the banks. If it's truly an error on their part, then I hope it's rectified shortly. Even if it is, you should be monitoring your credit more closely. Good luck!

Yeah, it seems there definitely should have been a payment due in September for the August charge. I'm thinking he may be confused with payment due date and statement cut date and is paying late but I'm not sure. Also, he might think that because he paid 4 times the minimum on his first payment that he didn't need to pay again the next month. Iveseen people get in trouble like that before believe it or not. That's the only reason I could see somebody not making a payment between October 15 and December 26 and being upset because they're getting hit with lates. By his own statement he said first payment due 10/1 paid 10/15 right? That's why I was wondering if I'm reading all that right.
