What to do next

I disputed an account on TU and they deleted it.  It showed up on EQ as a new collection, reaged 7 years.  Now it is back on TU reaged.  TU did not notify me that they were reinserting it.  I DV'd the CA but have not heard back from them.  They still have 2 weeks to respond. The reinsertion was done after I got the green card back from the CA.
 
It was due to fall off this month and is way beyond the SOL.

The re-age is baloney. However, a CA can report up to 30 days while waiting to validate. If they don't validate within that timeframe, then they must cease all collection activities.

Do you have your old CRs showing that it was on there, then deleted, etc.?

Yep, I have them. Isn't the CRA also supposed to notify you within 5 days of the reinsertion? So, if it comes back validated what would I do?

Are you sure it was deleted & not just surpressed while it was disputed???  If you are sure that it was deleted send the CRAs this letter    make changes where needed.
 
IF already on your CR    the CA can keep updating until the 30 days are up OR answer your DV.
 
 
I am requesting that you investigate the items listed below.


Name of account, account number XXXXXXXXXXXXXXXX. This item has not been reported properly. After looking at past and present credit reports it has come to my attention that you have allowed this item to be reinserted into my credit file after it had been deleted. Based on the credit report dates the period during which this reinsertion took place was between XX/XX/XX and XX/XX/XX.

Pursuant to the FCRA, I'd like to be provided with copies of the certification required for reinsertion for this account.

Under the FCRA Section 611(a)(5)((ii) ". . . . reinserted in the file, the consumer reporting agency shall notify the consumer of the reinsertion in writing not later than
5 business days after the reinsertion or, if authorized by the consumer for that purpose, by any other means available to the agency.
(iii) Additional information. As part of, or in addition to, the notice under clause (ii), a consumer reporting agency shall provide to a consumer in writing not later than 5 business days after the date of the reinsertion
(I) a statement that the disputed information has been reinserted;
(II) the business name and address of any furnisher of information contacted and the telephone number of such furnisher, if reasonably available, or of any furnisher of information that contacted the consumer reporting agency, in connection with the reinsertion of such information; . . . ."

I was not so notified. I am disputing this item. I will allow you 15 days to furnish this information, however if you do not provide the information requested, you must delete this account as required by the FCRA. Please send me a copy of my updated credit report after you have completed this request.

I know in fact it was deleted because I got a letter from TU stating it was deleted. It is now showing on TU and EQ as a new collection as of Dec 07 but with the same account number.

Guiness, I had the same thing happen to me on the one collection that I had. I had to carry that garbage for about five years on my reports. It was set to fall off in Oct/07. It did from both EX & TU (wasn't reported on EQ). The following month, it crept back up on EX, dropping my score from 690 to 669, got nothing from EX stating that it had been reinserted. I noticed it in Dec, when my broker shared my CR with me. I found these forums that day and DV'd. Got the dunning letter w/in a week stating that it had been deleted.

Send that DV and the letter that HappyDays gave you to the CRAs.

I sent the DV letter to the CA. Do I need to wait till I get a response from the CA or just send the letter to the CRA now? Thanks

Differing opinions that I have heard here are as follows:

 Wait about 35 days to see if the CA can validate. If not, then send copies of DV letter, GC, and Cert mail receipt to CRAs and dispute that the CA didn't validate.

The other option that I heard is to dispute as soon as the GC comes back.

I personally like the first option.
