When?

Will these lates be removed from the CR with the three Bureaus. These items came straigt from my Experian CR and wondering when they will be removed. I am a bit confused because I have a DOFD of 7/2009 on an account, which will continue on my Experian CR until April 2016. This is more than 2-months early for the 7-years removal time frame listed. Is this creditor being kind with the early removal? If this is the case then all my lates, which occurred between April 2009 and September 2009, except one in April 2010, is schedule to be removed this year. Is my assumption correct? When this happens, will I get a significant bump in my CS.

Re: When?

Credit report exclusion is not "reported" by a creditor or debt collector.  They report the derogs, and then it is the responsibility of the CRA to monitor the time period for that type of derog, and exclude it from further credit reports they issue after the maximum exclusion period has expired.  They can exclude earlier, but the FCRA sets a maximum period for each type of derog after which it must be excluded from credit reports they provide.

The DOFD is used ONLY to determine the exclusion period for a reported charge-off or collection.  It does not apply to monthy delinquencies, which each have their own individual exclusion date of no later than seven years from the mo/year of their occurence.

The reported charge-off must be excluded no later than 7 years plus 180 days from the reported DOFD, but the CRAs typically exclude at approx 7 years.  That can vary, as  long as the CO is excluded no later than 7 years plus 180 days from the reported DOFD.

The DOFD is required to be separately and specifically reported to the CRA by the creditor whenever they have reported a charge-off.  It is not inferred by the CRA based on any reported 30-late.

Again, when the perod has expired, the creditor does not report anything additional to the CRA to bring about its exclusion, so the estimated dates provided in your credit report are not provided by the creditor.

Re: When?

Don't just wait for them to fall off.  Hit the Rebuilding subforum and see what you can do about getting them removed.  It's not always possible in all cases but you might as well give it a shot.
