Who is Watching?

When you DV or Dispute, is there someone that is actually keeping count on the 30 days that they have to respond?

Re: Who is Watching?

I have 4 disputes with Equifax since Feb. 9th online. Is that 30 or 45 days? I'm counting. If I don't hear, then I can send letters for no response, is that correct?

In the case of a DV, I'd assume it would be the person who received your DV. As for disputes, I dont know if CRA have some sort of system in place that alerts them when their time is almost up or not.

Do you mean is there a higher power(such as the FTC) watching and making sure they keep within time frames? I don't think so, it is up to you to make sure they are and take action if they aren't.

Re: Who is Watching?

There is a legal argument I have seen that an online dispute gives the CRAs 45 days to verify instead of 30.  So I'd wait until then to follow up.

Agreed and to add...the extra 15 is based on the condition that the CRA receives info at or near the 30 days mark that requires extra time to respond.

Re: Who is Watching?

i thought it was only an extra 15 days if you disputed using the free annual credit reports

Re: Who is Watching?

I believe the 15 days extra is only if you dispute using AnnualCreditReport.com or if you dispute online.

Re: Who is Watching?

15 days extra comes from the FCRA:

§ 611. Procedure in case of disputed accuracy [15 U.S.C. § 1681i]

Under (a) (1)

(B) Extension of period to reinvestigate. Except as provided in subparagraph

(C), the 30-day period described in subparagraph (A) may be extended for

not more than 15 additional days if the consumer reporting agency receives

information from the consumer during that 30-day period that is relevant to

the reinvestigation.
