I have a charge off with Credit One bank. The CA IS CACH of COlorado, LLC, and is being handled by Neuheisel Law Firm, P.C. I spoke to their rep on the phone the other day and asked if he'd delete my trade line once I had reached a 0 balance. He said he would delete the CACH trade line, but not the Credit One trade line. He sent me a letter that included: "5. Once all of your payments clear our bank account, our client will deem your account paid oin full, cease reporting it to the credit reporting agencies and remove its trade line from your credit report altogether." Sounds like it's what I want, right?? Once that is done, do I have any chance getting credit one to remove it? As of right now they wont even talk to me, I just get transfered to Neuheisel.

Yes si=ounds exactly like what oyu asked for.  In order to see what Credit One is willing to offer, unfortunatley, you will have to deal with them separately.  Mroe than likely not since they are only going to get a fraction of the debt owed.

what if i paid the balance to both of them?? it's only $600, but that seems like a small price to pay to have the TL deleted

BRAMMY has forgotten more then I will ever learn!  I have a few questions for you.
 
This law firm is out of Az.  They open an office in another state & hire an attorney to work it. This attorney might not know Jack $hit about consumer law!
 
Is the CA licensed in your state?  or do they need to be
Is the law firm in your state?
Did you send a DV to the CA before calling the attorney?  did they answer the DV?

Well, as of right now I do not know about their legal right to work in California. The person I spoke to from Neuheisel was in Sacramento. I initially tried to contact CACH and was routed to Neuheisel after giving them ID information. I told the guy I was working on a plan to take care of the debts on me CR and that I was going to work with the CAs that were willing to delte entries first. He told me that he couldn't do anything about the OC (Credit One ank) but, IF I sent in two payments, one this month, and one next month, to bring to a 0 balance, they would delete the TL for CACH. I'd also like to get the OC to delete, do I have a chance of that, and if so, whats the best method and timing in your opinion?

NEVER TALK TO A CA!!!!! They will promise the moon & you will get nothing.....everything in writing!!!!!
 
Send them a DV    CMRRR    they must answer within 30 days or stop reporting!!
 
What is the DOFD or DOLA  from the OC??

To Whom It May Concern:
This letter is being sent to you in response to a notice sent to me on DATE. Be advised that this is a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 (b) that your claim is disputed and validation is requested.
This is NOT a request for “verification” or proof of my mailing address, but a request for FULL MEDIA VALIDATION made pursuant to the above named Title and Section. I respectfully request that your offices provide me with competent evidence that (a) the account is valid, (b) the amount allegedly owed is accurate, and (c) I have a contractual obligation to pay Debt Collection Company Name for this alleged debt.
All of the following MUST be provided to adequately validate the authenticity of the alleged debt AND provide proof of my contractual obligation to Debt Collection Company Name for this alleged debt:
• Signed credit application between myself and the original creditor
• Copies of all signed vouchers from the date account was opened until default
• Copies of all statements from the date account opened until default
• Proof of the statute of limitations
• Proof of agreement that you were hired by the Original creditor (creditor as defined by the FDCPA) or
• A copy of the contract Debt Collection Company Name purchased the alleged debt.
• If the alleged debt was purchased, provide a copy of an agreement between Debt Collection Company Name and myself, signed by me, stating that I have a contractual responsibility to Debt Collection Company Name for the alleged debt
• Provide proof that Debt Collection Company Name is bonded/Licensed for debt collecting in the State of Your State
Be advised that failing to provide ALL of the media requested to validate the alleged debt will invalidate any and all claims Debt Collection Company Name is asserting regarding this alleged debt. If Debt Collection Company Name can NOT provide all of the validation media requested above, ALL collection efforts MUST be stopped and the account MUST be DELETED from the Debt Collection Company Name. If you can NOT validate your claim, you can NOT, by law, collect on it, or SELL it to another collection agency. Also, reporting a debt to the credit reporting agencies that can not be validated is a violation of the FCRA (Fair Credit Reporting Act), and carries a $2500 fine to be paid to me. I have two years to decide if I want to pursue this matter. PLEASE GIVE THIS MATTER THE ATTENTION IT DESERVES.
If your offices are able to provide all of the validating media as requested, I will require at least 30 days to investigate this information, and during such time, all collection activity must cease and desist.
I am also stating, in writing, that no telephone contact be made by your offices. If your offices attempt telephone communication with me, including but not limited to computer generated calls and calls or correspondence sent to or with any third parties, it will be considered harassment, and I will have no choice but to file suit. All future communications with me MUST be done in writing and sent to the address noted in this letter by United States Postal Service.

Well, as far as the DV goes, I have my last statement in hand all the dates and numbers, and I have called the OC to discuss the account and they look it up then send me to CA, which tells me they have the account info. I dont dispute the debt at all. I now have in my hand a letter from CA saying they will delete the TL from CACH (the CA) but that they cannot do anything about Credit One, the OC. So, I've already spoken to the CA, prior to being advised not to here. The issue as I see it is that there are two TLs on my CR, one from the OC and one from the CA. The CA TL, according to the letter in my hand will be deleted once I pay the balance. My problem is the TL from the OC. What do I do with that??
