You Could Already Be A Winner

A poster on CIC received a call from a relative. Idiot CA called and spoke with an in-law of the OP. Told the in-law the OP's name, debt owed, and the name of the company claiming the OP owed them money. Flagrant violation of FDCPA § 805(b), aka 15 USC 1692c.

No matter how colossally stupid a CA behaves, the rules don't change. You always DV a CA. Always.

If they are this dumb, then perhaps they will fail to validate when served with a timely DV, call one at 3 AM, threaten one with arrest, any number of other dumb things. The more they violate the law, the better it is for you. Perhaps you too could soon have your name on a lawsuit with a $100K+ judgement in your favor.

I wonder if it would be considered entrapment to include at the bottom of a DV letter a list of relatives names, addresses and telephone numbers with the specific imperative that they NOT violate 805(b) and contact any of your relatives about this debt. Removing tongue from cheek.
