assett acceptance welcomes me to their family

well, i posted last week about getting a letter from asset acceptance concerning an old dell account from 1999, and they said that they noticed that i had a mortgage inquiry, and wanted me to work with their "mortgage specialist", well i just got a letter form them today, "welcoming me to their family" their exact language. and it's for an old bally's gym membership, i literally forgot i had from years ago. last time i dv a ca, when i received such a letter, they immediately posted the account to my cr's.  after noticing the mortgage inquiry, i opted out the next day, but was told it may take a few days, which i guess means, that they sold my info within that time period.  anyways, how can i make sure that they don't post this to my credit report? its for $1400.  in my experience, it seems that as soon as i am able to get old things cleared up, those old skeletons that you forgot about just creep up.  it's like, they just wait until the time is right, and they all just pounce.

What is DOFD, DOLA and SOL?
 
If you send them a DV they can NOT report until they validate. But you want to know SOL and DOLA first.

i really have no idea, it just says bally's gym.  i can't remember when this was. it was either 2005 or 2006. not sure what catagory gym membership falls under.  don't know what technically dofd or dola was.  but, i will send the dv today.

I've never signed up for a gym membership, but do you fill out membership papers and sign things? If so, I'd say written.

i know, it was a stupid whim, especially since i never went, that was the dumbest part.  but, i don't get where they came up with 1400.  so, we will see in the next 30 days.  if i do dv within my window, and they report to the cra, or if they send me the paperwork at the 30 day mark, and report to the cra the next day, what is my recourse of action?  do i show the cra my paper trail?  i'm just wondering about the time frame, so, i have 30 days to dv them, and they have 30 days to answer me, but if they wait until the end of the 30 days, then what? thanks for helping me understand this process.  i'm trying to be more proactive now, instead of ignoring the letters, hoping they'll just go away, or just plain forgetting about them.

There really is no time limit they have on answering. The only thing they must do is cease collection activities until they DO answer you. If they never answer, that is fine....as long as they cease collections.
 
If they validate, the can report.
 
If they do not validate and it ends up on your CR, then you need to send copies of your greencard, CM label, copy of letter you sent to the CA, and a letter to the CRA to get it deleted.
 
Keep all your paperwork.

READ THIS!!!..All you have to do is write a CEASE AND DESIST letter to Asset Accepatnce..Asset Acceptance tried to pull this same Scam on me from a Bally`s gym membership from 1993..The SOL (Statute of Limitations) expired after 7 years..The collection agency IS allowed to take collection activity UNLESS you tell them not to..Bet you didnt know that Smiley Happy...Since my so called debt was more than 7 years old..it can not be reported to the credit bureau and I can not be sued..BUT,they can try to collect on you UNLESS you send them a letter CERTIFIED MAIL/RETURN RECIEPT REQUESTED..The letter is a simple statement saying "I REFUSE TO PAY THIS DEBT BEACUSE (EXPALIN ANSWER) i.e.STATUTE OF LIMITATIONS HAS EXPIRED..I HEREBY ASSERT MY RIGHT UNDER SECTION 805-C OF THE FAIR DEBT COLLECTIONS PRACTICIES ACT TO REQUEST YOU CEASE ANY FURTHER COMMUNICATION WITH ME"..After they recieve this letter they are not allowed to communicate with you..a..Doing this simple step RENDERS ASSETT ACCEPTANCE POWERLESS..just remember Asset just bought your debt and they are not the original lender..they basically can not collect,unless you choose to just give them your money..DO NOT EVER TALK WITH A DEBT COLLECTOR ON THE PHONE,COMMUNICATE VIA CERTIFIED MAIL ONLY AND NEVER MAKE A PROMISE TO PAY,IF YOU DO THEY CAN REPORT YOU LATE FOR 7 MORE YEARS..AGAIN..NO TALKING ON THE PHONE TO DEBT COLLECTORS IN ANY SITUATION AND ONLY COMMUNICATE VIA CERTIFIED MAIL..Hope this helps alot of people..Does Asset Accepatnce prey off people who do not know thier rights?..please educate yourself and dont let them steal your money!
