it's been 7 years, what happens if????

i have a collection(havent paid it still has a balance) that is up for drop off on my CR next month, after it deletes can it be relisted on my CR or sent to another CA? If it is sent to another CA can i dispute it since the SOL has past and was for deletion in april? is the original CA relists it, will the 7 years start over again? Lets say that it gets deleted next month as according to EX, then I pay it, can it be relisted on my CR for an additional 7 years?  the balance is small $215 so is it worth their time to relist and try to collect?

it comes off after the 7 to 7 1/2 year mark (some fed and state debts have other timelines) and it shouldn't come back on the cr's. that doesn't meen you still don't owe it, or even meen they still won't try to collect.
 
you can use the sol as an affirmative defense if they true to sue, and dispute as past crtp if it hits the reports again.

They may try to relist, but as ducky said, it's past CRTP, so that would be your dispute.

This happened to me (I explained in detail in another thread). Anyway, the CA was trying to collect on behalf of a timeshare that I had sold back in 1999 or 2000. They were collecting HOA fees thru 2004. I told them to take a hike. Anyway, they remained on my reports until 10/2007. It dropped off and came back on in Nov. I disputed and DV'd the CA and they sent me the dunning letter stating that it is being removed from EX & TU.

   OK so lets say that the current CA relists it or sells it to another CA that lists it, then i need to dispute it with the CRA's and send CA a DV stating that the time frame has past the SOL and the CRTP and that they must delete? what if they dont? also what about their still being an out standing balance, even w/that, they cant relist or reage it?
 
I called them before i found this time and said i would make payments to them for $25 a month, HOWEVER i have yet to make the pymt cause i figured why waste the money on that collections if it falls in april anyways so i will just put the money towards another collection that wont fall off for another 3 years. is me calling them starting the SOL again?

They can't just perpetuate the debt like that. CRTP is clear about the 7-7.5 yrs from DOFD. So, while they can sell it to JDBs, none of them can report it. If the do relist and you dispute 'past CRTP' with the CRAs and they don't remove it, then you can sue the CRAs.

No, calling them will not reset SOL, but paying them most certainly, usually does (how is that for commitment):smileytongue:

    thanks you soooooo very much, well it's good to know that i am out of the clear on this one, i just hope that it isnt reported again so that i wont have to go through the hassle of reporting or sueing anyone.

Even if it is, it will be a minor short-term inconvenience and due to a violation, could possibly be worth some $ in your pocket if you decide to sue.
