still confused ..help

ok here is the specific item for which I am referring to

Collection agency [?] 883yc00034 Original balance [?] $1,963 Current balance (as of Mar 01,2005) [?] $1,963 Status (as of Mar 01, 2005) [?] Unpaid Date assigned [?] Jan 01, 2003 Date reported [?] Mar 01, 2005 Date last active [?] May 01, 2002 Original lender [?] North State Tel

my confusion is that this debt was from mid 90's..i have'nt recieved a bill for this since before 2000 and yet the last reported date, as you can see, has been moved up to 2005. I read somewhere today that a collector could not change those dates without a notice or written collection to me. If these dates are assumed legit, then this item would not go off my report untill 2009, thereby staying on my CR for over a decade. BTW Experian is the only CR that contains this collection. Also I read something about SOL (statute of limitations). Does this apply to this item? Any help would be greatly appreciated.

Re: still confused ..help

You need to pull a report directly from the CRA or an annualcreditreport.com so you can ge tthe name of the CA.

If this is from the 90's it should not report anymore and certianly should be past SOL.

Send them a DV with ITS letter.

If they do not comply with the DV sick the FTC, your AG and their AG on them and consider contacting naca.net for a consult wiith a cusumer lawyer.

Many states have NO  SOL on hospital bills.   Other medical bills have SOL.

The report date only means that that is the date that they reported.

This is from a phone company (I think) so  this would be a CA.  You know that you SOL and CRTP is past.

Do NOT dispute it YET

If not a hospital bill  and you are sure that it is past CRTP  send this letter. Make changes where needed.    LIKE:  I pulled my CR and see that you are reporting

RE: [insert account number or name of account or name of debt]:
Dear [insert collector's name or company name],
This letter is in response to your [letter dated xx-xx-2005] (copy enclosed) or [phone call on xx-xx-2005], concerning the collection of the above referenced [account or date].
I do not believe I owe what you say I owe therefore I dispute this debt. I am well aware of my rights under the Fair Debt Collection Practices Act (FDCPA) and my state laws so I hope to save both of us a great deal of time by letting you know that not only do I dispute the validity of this debt, I have also checked with my State Attorney General and verified that the Statute of Limitations for enforcing this type of debt through the courts in (insert your state or the state in which the contract was signed) has expired. Therefore, should you decide to pursue this matter in court I intend to inform the court of my dispute of this debt and that the "statute of limitations" has expired.
This letter is your formal notification that I consider this matter closed and demand that you, or anyone affiliated with your company, stop contacting me regarding this or any other matter except to advise me that your debt collection efforts are being terminated or that you or the creditor are taking specific actions allowed by the FDCPA or my state laws.
Be advised that I consider any contact not in accordance with the Fair Debt Collection Practices Act a serious violation of the law and will immediately report any violations to my State Attorney General, to the Federal Trade Commission and, if necessary, take whatever legal action is necessary to protect myself. Be advised that I tape record all phone calls and violations of the FDCPA can result in you or your company being personally fined up to $1,000 per incident.
