Ok..Here is my situation.....Previously sold my first house 1/06 (Recording date), rented for the past three years and bought a home once again which closed 4/29/09. Here is my question....I have read on these posts that you have to not have owned a home for three years and it looks like I qualify in that regard, but I filed my taxes at the beginning of 4/09, but want to get back the credit now, not at the end of the year. Is it too late to file an extension? Is this the proper way to do this? Do I have to wait until I file this next year since I bought the home during 2009? Please help me understand my best move as I want to put this credit to work for us now and pay off our high interest auto loan.
You file a 1040X (amended return) and the 5905. On the 1040X you skip all questions go to page 2, write an explanation and attach the 5905.
