Apply for mortgage if lawsuit pending? Is it possible...

CA violated one of the FCRA rules/bylaws, I contacted an attorney regarding this. The CA wants to settle but I asked the settlement to include the removal of the CO from my CR. Haven't heard back from attorney as of yet on this addition to the settlement....question is can I still apply for a mortgage with this lawsuit pending?

I don't know the answer to your question.

 

But, CONGRATULATIONS for

 

1.  Being in a position to ask the CA to delete!

2.  Being in a position to apply for a mortgage! 

 

If it were me,  I would wait until the CA has deleted the collection from your CR before you apply for a mortgage.  Give your FICO score a chance to rebound, present the best possible picture to the potential lender...
