No, on Feb 1st we showed up to close with cashiers' check in hand and were informed by our realtor that she had just gotten off the phone with the seller's agent and they didn't have the money to bring to close. We sent them an amendment to close Feb 6 and they didn't sign until I mentioned to the mediating broker about suing for specific performance, which incidentally is an option granted to the buyer in our contract in the event of a seller default.

I'll let you guys know for sure. Even though I'm new to this forum and haven't posted much reading other's experiences has been comforting to me throughout my ordeal.

This morning my realtor forwarded me the email chain from the Seller's relocation company saying they were going to wire the money over to the title company today and with any luck, we'll get the signed papers via fedex from the seller tomorrow and everything will fund and we'll close.

 

However, as of yet the title company states the funds have not arrived and once again the seller's realtor seems to have fallen off the face of the earth. Not holding out much hope this will be resolved tomorrow. Maybe by Wednesday.

 

Also our property manager emailed me today stating he received our move-out notice and was surprised and shocked because we "have been one of their best tenants." He then goes on to say we're risking our credit (our lease isn't up until May) and they can attempt to lease the property "but there will be fees involved." He asks what our plans and intentions are then mentions that the owner will likely want to file an eviction that will go on our record. I was honestly surprised at how menacing his email was considering we've always paid our rent on time and the turnover in our current neighborhood is ridiculously fast. I haven't seen a unit unoccupied for more than 2 weeks, and people are moving in/out all the time.

Yours is one of the most amazing stories I've read in my time here.  I can't believe people would carry on like this.  I can only imagine what it's putting you all through.  I hope it works out for the best and will keep checking in as you post updates.  Hope to hear you all get your keys and can be done with these sleazeballs tomorrow!

We are dealing with something similar with our landlord but our landlord is private. We have been renting month to month since May and we signed 3 consecutive year long leases prior to the last one ending so we have been here for about 3 1/2 years...never EVER paid our rent not even on day late, always mailed out before the first. Our landlord wanted us to buy her property but she was selling a very shady deal. When we told her we weren't buying her property, she sent us a notice to vacate by Jan 31st or she will evict. I had to get an attorney involved but we are finally closing Wed or Thurs and moving Friday. It's Feb 4th and it has been silent so I don't know if that is good or bad, all I know is I want and need to get out of here.

Unfortunately, with your situation they can do all those things you mentioned for breaking a lease. I recommend that you leave the house in perfect condition so that they can re lease it quickly. If they don't re rent right away, they will come after you for the months of rent while the apartment was vacant and many property mangers do file an eviction even after you left to further damage your credit. I would try to work out a deal with your property manager as soon as you can.
