We've paid through February and the unit is move-in ready. We've already shown the property twice since we've had it cleaned and our stuff out Sunday aside from having several interested inquiries so I'd be surprised if he doesn't have a new lease before the end of the month.

Just becareful how you handle it.

Even if he rents the property you may still have to pay until your lease term ends. Im not very well versed in this, but Im sure you can search information, and when in doubt you can always try and get a FREE consultation with an Attorney.

The terms outlined in our lease agreement state if we find an acceptable tenant to assign/sublease/new lease we have to pay an 85% penalty of one months rent.

If that wording takes into play and they find the tenant, what then?

It's the same result for both contingencies.

Then I think you should be okay. Still would want something in writing to say you fulfilled all your obligations and no other payments are required, and no damages.

Or something like that...
