Is there a mortgage contingency clause in your contract? Aren't most contracts subject to financing? Shouldn't you get your deposit back if you don't get your loan?

The builder is saying I defauted on the contract because of the new credit issues.  My attorney will review this week

Yes I did.  Wells will not FHA approve anyone under 600
