Mortgage and judgment

My husband had a default judgment placed against him that we weren't aware of until we tried for a mortgage. We were told to make 6 payments to qualify. We made 6 payments with no problem. When payments 7 and 8 didn't post to our bank account, we contacted the law office that was handling the account and found out that they closed the business.
After many calls to the original creditor, we finally were given contact info for the new firm handling the account. We've been calling them for 2 months and keep being told that my husbands account is not set up in their system yet.
We called the original creditor to see if payments could be made to them in the interim but were told no. We found a home and are now under contract. We have written a letter of explanation detailing this including proof that the law firm closed and contact information for the new law firm in the event they need proof. We can easily afford the payments so its not a lack of desire or ability to pay. We've gone through so much to finally purchase a home and now this happens. Do you think this will be a deal breaker?

Is it at all possible to pay this off?

 

If so, all you have to do is provide the funds during escrow and they will pay it for you.  If the check gets returned to escrow after closing, who cares.
