The title company takes care of that. To clear title you just need to pay off any liens on it, so when they sell their home and your mortgage company funds their new loan, it'll pay off the mortgage lien against the home, and all other sellers liens (tax, judgments, etc.) would need to be paid at closing before your lender would agree to allow the settlement agent to disburse funds.
